    • Oh that is very helpful, thanks a million for answering my query. Looking at the license right now. At the front it says the issue date is 2022 (that's when I swapped it), but at the back it says 2015 next to Category B. So, I'm definately at 12 points, right?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

AQ completed with excellent guidance from jonni2bad's guidance notes. I think I'll be raiding the kid's money box for the £100, but it's better spent on an AQ than on sweets.

It's exciting but sooooooo frustrating that you can't influence the process or speed things up at all. This next stage looks like it's going to be a month or so before we get any real developments, so it's good to be able to talk to other peope at the same stage in their claim.

 

Just have to keep smiling and wait for the postman, but news like Mad Nick's helps the wait go along easier. :)

I've not heard anything since my Aq went in last week, but judging by some other threads there can be a lull of about a month until you hear from the court. I'm hoping mine might be a bit quicker because with being Fast Track I'm asking for standard disclosure which should focus Abbey's attention a bit more.....................but maybe I'm just being optimistic.

hi Charley,

 

keep me informed great to hear from u i spoke to court today as i didnt send them copy of good will gesture and abbey had contacted them and said a payment had been made i did post letter recorded delivery to refuse it so sending that onto court now.

 

abbey not sent in AQ from them.

 

still little confused with this standard disclosure business i do understand what it means but how do u ask for it.

You request it on your AQ!!

 

But the judge will most probably state it in his directions. It speeds things up because the court date might be 2 months ahead, but disclosure of documents must take place much earlier than that.

Just phoned the court to see what the score was about my AQ, and apparently there'll be a letter waiting for me when I get home.

 

Allocated to the Small Claims(that's a PAIN, because I wanted Fast Track for standard disclosure) with a date for 6th July...........that's months away!

 

I'll have to wait and see what the letter says about disclosure and exchange of documents.

The courts are obviously busy with people claiming their bank charges back:)

 

Well, I can't really comment without seeing the actual letter, but I'm going to be sending everything off to Abbey asap........court bundle etc etc......to try and speed things up a bit.

Letter from Court didn't arrive yesterday, so I snuck home at lunchtime today to get it.............................and it's still not arrived:mad:

 

Anyway, court bundle print run is all done. All I need to do now is copy my correspondence and statements, and find the obligatory pink ribbon to tie it up with a neat bow:)

Hi hun,

 

I actually had to do some work today, and then this evening I've been watching my son play football, which was good.

 

I can't believe I'm still waiting to receive the dirctions from the court. When I spoke to them on Wednesday, they said they'd sent them out already. I only live 10 minutes drive away from the place, I could have gone and picked them up.

 

Actually I'm hoping it's a mistake and the lady at the court has got me confused with someone else, and they've gone with my draft directions word for word:lol: :lol:

It's terrible when life interferes with your claim isn't it? :D :D Hope your son's team won!

 

You never know, they're probably busier in the courts now than they've ever been ~ so you might be lucky!

 

Abbey didn't acknowledge my claim but I have received their defence so I'm watching those of you at AQ stage closely to pick up tips!

They won 2-1 and it was a really good game.

Oh Charley , I was hoping you had some news by now ! I have been back onto the court and the Judge is still looking at the AQs . I did get a tad worried as I saw another thread (cant remember who) and they were on the same timescale as us , and their papers were transferred from Lambeth County Court to the Mercantile Court . I was going to have a read this evening (yes I know it is Sat night) and see if that would make any great difference to my claim. Good luck - if I dont hear anything ,I too, will ring the Court on Wednesday .

Well lo and behold!! directions from the court............Notice of Allocation to the Small Claims Track on 6th July. (bo***cks)

 

Copies of all documents 14 days before hearing date(more bo***cks

 

Any costs for the successful party are limited to the maximum that can be claimed in the FT.

 

Court bundle nearly done and will be sent this week to try and chivvy them along a bit. Can't see me getting any money until the end of June at the earliest:mad:
