      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have received an email from Solutions@idrww. com concerning my credit card debt with Mashreq Bank in Abu Dhabi from 2021.

I left after being made redundant.

What should I do please?

simply write to the BANKS informing them of your correct and current uk address.

emails etc should be blocked and bounced as can txts/phonecalls - report all txt's as spam to 7726

have you moved around since returning to the uk?

great perfect situation

you can ignore everything and everybody

the only things you dont ignore are LETTERS which are any of these:

a letter of claim with a reply pack wanting I&E etc

a Statutory Demand (though most of these from IRDWW are 'fake')

an N1 court claim pack from northants bulk court.

emails/txts/phonecalls - very safe to block bounce ignore delete - txts report as spam to 7726

Hi, I have just received a letter from Moneyadviceservice with regards to my Mashreq Bank CC debt.

Is it ok to give them my email address instead of my home address as my wife opened it and is now worried.

I don't want to receive anymore letters in the post.

Please advise, thanks.

tell them to do one.

all these orgs do is encourage people to blindly pay up as they are funded by the Banks and the DCA's

they dont get involved if a creditor approaches them.:noidea:

My apologies,

I have reread the letter my wife sent me the picture of.

It is from International Dept Recovery.

That's all I can make out as the top of the letter is not clear. 

I am not in Scotland, but I do work away from home during the week so can't get hold of the letter until the weekend.

IDR are the same people you came here with.

there is no legal way to stop letters.

tell you wife to read here on them

that'll soon quell here worries.

if shes worried about say things like bailiffs or losing you home....NONE of that can EVER happen.

IDR are just a bunch of $&$^" that get a cut if they find a mug to pay up on these debts.

I have had the same issue but think my threads are now closed 

I ignored as per the advice and idr etc stopped communication. 
 

I had a text today from judge and priestly asking me to contact them and the ref code is emirates something so assume it’s about the same thing. 
I think they just pass it around companies to Chase in the hope we blindly pay it like dx said

Hi mate,

Another IDR letter today, now they are saying they have recommended their client should refer to a solicitor.

They also claim they can take legal action to obtain a CCJ. Have money taken from my salary, a charging order secured against my property and any sale of the property, remove goods from the house.

I don't believe they can legally do that can they?

doesnt say WILL anything read it properly . only the bank can raise a court claim.

and they'd have to win in court first....fat chance of that.

as for the rest, remove goods....:pound:

you need to read other threads then you wouldnt keep panicking every few weeks when the next threat-o-gram drops.

I have had letters at a rate of 1 a week for the last 6 weeks, so not panicking. I was only saying what is in the latest and asking for your advise, which you have given, thanks. I never said WILL only what they have written in the letter. Cheers.

got about 6 of them 

just to add they do take people to court etc but from what I see is they dont give them warnings. ie this is all bluff trying to get you to answer. In fact they play the system and dont want you to know they are going the legal way so this is nonsense.
