    • Firstly, I would like to thank everyone for their help in this matter. Since my last post I have received a reply from Plymouth Council Insurance Team concerning my wife’s accident (please see enclosed letter and photo of the offending Badminton post) which they deny any responsibility for the said accident. I feel that the Council is in breach of their statutory duties under the following acts: The Leisure Centre was negligent in its duty of care and therefore, in breach of the statutory duty owed under section 2 of the Occupiers’ Liability Act 1957. Health and Safety at Work Act 1974 (the Act) to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all their employees, and others who might be affected by its undertaking, e.g. members of the public visiting the Leisure Centre to use the facilities. The Management of Health and Safety at Work Regulations 1999 that requires employers to assess risks (including slip and trip risks) and, where necessary, take action to address them. The Provision and Use of Work Equipment Regulations (PUWER) require the risk to people’s health and safety from equipment that is used at a Leisure Centre be prevented or controlled. I would like some advice to see if my assumptions are correct and my approach to obtaining satisfactory outcome to this matter are accurate.     • Talking to them does not reset the time limit, although they will probably tell you it does, they'd be lying. Dumbdales are the in-house sols for Lowlife, just the next desk along. If Lowlifes were corresponding with you at your current address then Dumbdales know your address. However, knowing that they are lower than a snake's belly, you would be well advised to send them a letter, informing them of your current address and nothing else. Get 'proof of posting' which is free from the PO counter, don't sign it, simply type your name. That way then they have absolutely no excuse for attempting a back door CCJ.   P.S. Best course of action, IGNORE them, until or unless you get a claim form......you won't.
    • A 'signed for' Letter of Claim has been sent today so they have 14 days from tomorrow... Lets wait and see what happens but i suspect judging by their attitude they wont reply

    • Hi All, So brief outline. I have Natwest CC debt £8k last payment i made was 7th November 2018 Not a penny since. So coming up to the 6 year mark. Can't remember when i took out the  credit card would be a few years before everythign hit the fan. Moved house 2020 - updated NatWest as I still have a current account with them. Then Lowells took over from Moorcroft and were writing to me at my current address. I did get a family member to speak to them 3 years ago regarding the debt explained although it may be in my name I didn't rack it up then went contact again. 29th may received an email from overdales saying they were now managing the debt. I have not had any letter yet which i thought is odd?  Couple of questions 1. Does my family member speaking to lowell restart statute barred clock? 2. Do you think overdales aren't writing to me because they will back door CCJ to old address even though Lowells have contacted me at current address never at previous? ( have no proof though stupidly binned all letters  ) Should I write to them and confirm my address just incase? Does this restart statute barred clock? 3. what do you think best course of action is?   Any help/advice is appreciated I am aware they may ramp up the process now due to 7th December being the 6 year mark.   Many Thanks in advance!       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I should have started this months ago, but I have been raped and pillaged that many times by the bank I was numb, but the worm has definately turned and my data information letter is being sent today.

 

I have my parachute account up and running just in case.

 

Anyway here goes

your SAR should take 40 days did you include the £10 fee? anyway while your waiting all the advice to give you is keep on reading that way anything that crops up regarding your case you will be prepared for !

How did you get on v Ulster Bank?

 

I requested statement of charges on 19th April, so 40 days just up, I've heard nothing but have proof they recieved it.

Yeah got them on the 47th day and posted off my spreed sheet and letter i got from another site, but all claims are dealt with in Dublin now so i have to phone tomorrow to see if they have recieved it, will keep u posted .

Thank-you, I'd really appreciate knowing how you get on and it will let me know whats likely to be around the next corner.

 

I phoned Donegal Sq East this morning got put through "Branch Support" who put me through the the "Care Team" who put me through to " Customer Relatuions" who said they'd call back but didn't.

I called them again and they put me back to the "Care Team"!

 

So I've lodged a complaint with the Data Protection Commissioner and am just about to post a letter another to the Ulster Bank informing them of my actions.

 

What you PADI if you're still reading this, how are you getting on?

If they have not complied within the allocated time don't waste your breath phoning them. Go into the templates section of this site and print of the non compliance letter giving them 14 days (it says 7 days in the template letter. I gave 14 as I had to read up on the court procedure for this) to issue you with your information before you instigate legal proceedinds against them. I then got all my statemnts.

Thanks belfastgirl, recieved the PM.

 

I also recieved 6 months statements from the Ulster Bank, with a cover letter stating the rest will follow.

 

In the 6 months recieved there are £155 of charges.

I got a reply from the bank yesterday :

 

 

Thank You for your recent letter reguarding the fees applied to your account.

 

We note the contents of your letter and will now carry out a further review of your complaint. In view of the work invovled we anticpate that we will not be in a position to respond to you for another 5-6 weeks. However, we will endeavour to do so sooner if we are able to.

 

Meantime, perhaps you would send us any relevant information which you feel would substantiate your claim, for instance, your bank statements with your claim amounts highlighted In this reguard, we will refund your account with the postage or photocopying costs incurred by you. If i do not hear from you within the next ten days i will assusme you have no documentation to forward.

 

Please bear with us whilst we continue to investigate on your behalf

I got the exact same letter yesterday in the post. Having been on the moneysavingexpert site, I would at this stage start my claim online but I've read claiming fees back in nothern ireland? thread, posts 111,117+118 and apparently the courts have suspended all bank charges claims until some sort of statement is made. So I think I'll do what I'm asked and if not happy with final response, I'll put my complaint to the financial ombudsman. What are your thoughts on this?

Are they asking you to go into detail for every charge?

 

My last charge was £30 for bouncing a cheque, I wrote a cheque for £66 for a passport application, from my online banking facility I was able to check the account as I had transfered funds to my current account from a savings account at another bank but didn't know if it would clear in time.

So when I seen the £66 cheque presented first, I lodged sufficent cash that day at 11am. They still bounced it! I called them, they said the funds had to be there the day before. The last time this happened to me, I had lodged the funds in the afternoon and they told me in had to be done before 12 noon which is why I rushed this time to lodge before 12 noon.

That was the straw that broke the camels back and is why I'm taking my current action.

 

Problem is, I would not be able to go into the same detail for charges months or years ago.

After this they say-for instance, your bank statements with your claimed amounts highlighted.

This is all they will be getting from me, as I think possibly this is all they are asking for, as sending them relevant information which I feel would substantaite my claim-I've already told them in the first letter, I do not believe these charges reflect the true cost to ULSTER BANK and I believe I have been unlawfully deprived of the money and in the second letter when I told them I intend to claim through the county court based on the Unfair Terms in Consumer Contracts Regulations,as I believe these default charges are unfair and not proportionate to your costs. Of course I got this info from the template letters off Money Saving Expert: Consumer Revenge:Consumer Revenge - Credit Cards, Shopping, Bank Charges, Cheap Flights and more

 

I also found out like yourself,that they changed the rule of being able to put your money in before 12 noon on the day and that you are now supposed to have it in the day before to cover anything going out the next day.

The latest, I recieved the rest of my statements today

 

For approx the first 3 years, when the account was in joint names with my ex, the total was £1188.79.

The last 3 years, sole account, £1183.47 giving a total of £2372.26.

 

These are made up form various charges like, DD Create, DD Cancel, I/R Account, Fee, Interest, Fee Bal Letter etc etc.

 

A few questions;

 

Are all charges reclaimable?

 

Might I have to involve my ex in the claim for the first 3 years?

not all charges are reclaimable. things like setting up DD or anything classed as a service cant be claimed. referal fees,fees for bounced cheques or DD,s, letter fees are all reclaimable. what kind of interest do you mean?

Loads of small amounts charged for interest from 28p to £20.

In the earlier statements it simply says INTEREST then amount, in the more recent statements it says something like, INTEREST 0.10 LESS TAX 0.02 (then I'm credited with 8p, then immediately below that, 21May2004 - 20Aug2004 INTEREST 3.03 and I'm charged £3.03.

Someone has posted saying the Ulster Bank paid them the full ammount (£1700) this has given me great hope!

I still haven't had a reply to my letter requesting a refund after 19 days, so I've just sent a LBA, giving them a further 14 days, then start proceedings without any further correspondance.

Problem is I'm in Spain from 18th July untill 1st August but if nothing is lying on my door mat upon my return I will go to court.

 

Hows everyone else getting on?
