    • wont go near it with a barge pole as its ex gov't debt.
    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.
    • was at the time you ticked it  but now they've still not complied . if you read up, here , you'll see thats what everyone does,

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bank Parking ANPR PCN PAPLOC Now Claimform - wrong reg - Appeal failed - Belvedere Street Car Park, Mansfield, Nottinghamshire, NG18 1JJ

Recommended Posts

I am puzzled as to why the registered keeper has to fill all this paper work in when it is the driver who is responsible,

do you fill in about the expenditure and income

do you have to send proof of all your income and expenditures

and do I send proof off of the keepers disabilities?

No idea what to put as a defence other than a ticket was purchased and that registered keeper is a none driver

Do you send all the pack back together with the Acknowledgement and the Defence to this Court business Centre at Northampton?

The claim says the driver agreed to pay within 28 days,

how can they state this when the driver has not been identified and no one has stated they would pay.

I don`t know which way to turn

if only I could do this thing online but can`t get it to accept the claim number or password so I cannot get anywhere,

I cocked the post code up

tried to change it and tried to register again

I have caused it not to accept the password and claim number

All this is so difficult to someone who is not used to this procedure

Aah thanks Dave I lack so much confidence with my many burdens I cannot tell you how appreciative I am with the CAG you are all a god send to many, just a defence to sort now which will have to be by email again I assume? as I cannot log on to the Court.

When I appealed it was the IAS who had the car reg wrong not the parking company thought I would stress this again as I did originally state this, I thought this needs mentioning before any appeal is thought out

Yes I will let them know that I made a mistake and set two up, the first one must be dead as it not let me get on it but the second one lets me get to the claim number and password but states they are incorrect

Found this interesting read it on the internet

PCN received from my local Tesco

I spoke to a member of staff and they claimed that they had nothing to do with the parking. I explained that the ANPR system is an expensive piece of equipment (up to 30 grand) and the company that owns it had to have a contract in place with the company that leases/owns the land.

Some company didn't just turn up one day and install this kit on a whim.

there has to be a way to contact the camera company.

I worked in security for 10 year and have used a similar system.

They graciously emailed and told them to cancel the ticket.

I wasn't nasty but I was insistent.

Many companies will just fob you off and that infuriates the hell out me as too many people will just accept not knowing how these systems work

  • 8 months later...

A letter was sent by the Court but not received then another letter came in the last couple of weeks saying needed to answer to directions, filled it in sent back to Court said did the defendant agree to Alternative Dispute Resolution and not heard anything since

Not heard anything for months so wasn`t able to update had Pneumonia been very unwell, this has been the last thing on my mind, as did think after all the advice on here that the claimant would throw the towel in.

My apologies for not updating.

MCOL cannot do anything or look on it as it would not accept password etc so everything done by post unfortunately.

Sent copy to their solicitor and kept one for myself, had to give phone number for mediation no idea when that is meant to happen.

A General Form of Judgement N24 form came saying we had failed to file the directions Questionnaire and had 7 days to do so as of 12th October 2023. (Failed to file the original directions questionnaire has nothing was ever received)

Emailed the questionnaire and sent a hard copy to CCBC.

The form filled in was a N180 Directions Questionnaire (small claims track)

It has been over a month and not heard anything else from the Court or Mediation
