    • Thanks very much, would just be reassuring to know I still have options at that point, and can avert anything nasty if needs be?  No idea what nasty would look like for me in regard to this but I worry about being done for fraud because I applied for the loans when I was not a UK resident and promptly transferred the funds abroad upon receipt.  Neither was allowed under the terms of the loan offer. Would they look into that sort of thing?  (Am I putting myself at risk admitting that here and should I delete this message, seeing as my gmail address is associated with this). I feel so ashamed admitting this.  As I mentioned in my first message, I was horribly manipulated into doing all of this and then scammed.  I fully intended to repay the loans and did my best to do so for over 2 years before my income took a massive hit in Oct last year.
    • no need to do anything before a letter of claim, then you can come here and we will help you. Most of these debts are sold on for a few pence in the pound to DCA's, who will try and make you think that they have legal powers. Ask yourself the question why so cheap?
    • Thanks, good to know.  Is it best to engage with them once court proceedings begin?  I've noticed advice on the thread saying ignore everything until Letter of Claim or notice of proceedings - so that suggests there is something I could do before/when that happens that is important? Would like to know what those actions/options are for me to take at that stage, to factor into my decision now weighing up the risks etc.
    • 6 years from date of DN/Last Payment to take you to court.   Further 6 years to enforce the CCJ.
    • Well I have none, so I think me telling them would be a proactive preventive step to "help" them weigh up whether to proceed with court action.  Doubt they would do so if they knew it was a waste of time because I own nothing they can send bailiffs to or put a charging order on.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I used my dads badge to park in Birmingham today and I shouldn’t have because he passed away last year.

I didn’t have money for parking and having two children in the car, I decided to do so for quickness.

I know I shouldn’t have but I did. 


A person from the council came and took the badge and said the council would be in touch as it is classed as fraud.

I’m worried sick. , I am a single mum of three and can barely afford to live as it is (even though I work) and I’m really concerned about what I have done. 


Any advice would be really appreciated!

How would I pay this? Would I have to pay it in one go as I can barely afford to live now and do I have to go to court?

 

I’m a assistant teacher and I can’t believe I have been so stupid!

No, wouldn’t do anything like it again! Never did it before!

I had driven around the car park and looked at the tariff and with the two kids fighting in the back of the car.

 

I pulled in the disabled bay, put the badge in took one child out the car and then was going in the boot to get my bag to go and pay for parking when I was stopped!

 

I know it was a silly thing to do looking back but at the time I didn’t think. 

 

Still so stressed about this… I’m hardly sleeping and can’t stop thinking about it! If anyone has more info on what actually happens I’d be most grateful! Thank you

Yes he took it off me and asked for my driving license. He took all my details down and I had to sign a piece of paper. He also took a photograph of my car and me.

To be quite honest the guy didn’t give me a chance in edge ways to speak.

 

As soon as I got out the car he approached me and asked to see the badge. My son got out the car too as I was taking him to the pay machine to stop the arguments with my other son.

 

I passed him the badge and typed him the details from there.

He asked why I had used it and I tried to explain. 


He then took photos and said I would be prosecuted and read my rights to.

I said I hadn’t done anything like this before but he kept going on about how I’d misused it and how it was fraud and I would be prosecuted!

 

I explained that I was sorry and under a full understanding that I wouldn’t do anything like it again.

 

He asked if I had any questions and I asked what happened next, he told me I’d hear off the council and be prosecuted. 


It’s honestly really worried me!

 

Im hardly sleeping and it is on my mind constantly!

Thank you for that, it is much appreciated! I’m going to lose my job and career unfortunately as a result of this. I’m absolutely gutted…. Been in the education profession since I’ve been 21 and I’m 37 now 😢

I thought any criminal offence would show on my DBS check and therefore would jeopardise my job. 
Im really worried about the whole situation, I haven’t told anyone about what’s happened, it’s on my mind constantly.

Absolutely dreading the 15th, literally having no sleep and worrying sick about it. 
Terrified on what an impact it will have on me, I could lose my job….

I live in rented accommodation, could they kick me out if I get a criminal conviction?
Will it affect things like car insurance?

My case has been transferred to Wolverhampton now as the court in Birmingham is closed. 
Im so worried about it, having no sleep and it’s constantly on my mind. 
If I’m fined I seriously don’t know how I’ll be able to pay it. I have no spare money
