    • Met are out of order in this new version of their PCN. They show your car arriving and leaving via the ANPR cameras. They then go on to describe this as the parking period knowing full well that since your car still has to drive to a parking space and later drive from the parking space to the exit. How this can be described as a parking period with so much driving involved is beyond me.    
    • I have a similar issue, I was caught shoplifting in M&S last fortnight (which I'm ashamed of) and I received a letter from DWF with the £125 fine and the price of the goods. I've paid the money. The police were not called, but a police letter was sent to a presumed suspect. Will this letter affect the options I choose when applying for a visa (I checked many posts and found no one who has received a similar letter). Is it all over after paying the money? I'm so anxious about it all!
    • I used to go to the Sainsbury's in the Cromwell Road London and my wife used to get PCNs there. I just spoke to a manage onsite and they were good enough to get them cancelled. If you take in the PCN , they photograph it and that is the end of it. Which is what should happen with major companies when their customers are ripped off by the rogues. Are you listening Mcdonalds and Starbucks?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I rang the FOS yesterday afternoon the handler emailed the ombudsman and the investigator directly for an extension but he said they might not get back to us in time the data protection officer has also acknowledged my request and emailed to say they will be sending the information directly 


Interestingly yesterday experian got back to me saying one of the loan companies omni finance are saying they've spoken to myself and completed DPA obviously it's not myself but I'm wondering if he's had a female impersonate me and would I be digging myself into a deeper hole, I need to speak to each company in turn myself by looks of it 

 

Spoke to omni finance its Z's email and bank details there too gave them crime reference will be getting passed to fraud team


I think in the meantime we should work on the rejection and objections on a letter in case the FOS doesn't get back to us in time what are your thoughts? X

@honeybee13I got a crime reference number @BankFodderI've rung companies directly where further loans have been taken and they were to buy his private registerations I have also raised the frauds with the companies 

@BankFodder the ombudsman got back to me saying an extension will be fine ive asked for 6wks but she hadn't confirmed that this is fine yet

@BankFodder shes responded on email to me to say its fine thats all I will respond to say thank you for confirming the extension I will endeavour to respond back to you by 22nd June 2021 

 

I have sent SAR's already to all companies but they've agreed to look into them as fraud

I sent them SARs around 10days ago and I disputed transactions with he credit agencies a lot are coming back saying data is accurate so I'm now having to ring each company to get them to remove their information from my report 

 

Yes police have all companies details and I've also provided companies with crime reference number

The companies im ringing are the soft searches that were done the loan companies have had SARs sent to them and they've asked me account details emails etc which aren't my email addresses or numbers so it's highlighting as fraud to them so they've referred it to their fraud team as these are settled loans which are paid so last thing I want is him filling out an indemnity claim with bank and having these reversed

@BankFodder I have had a little ray  of hope given to me one of the companies Z had taken a loan out with confirmed it was for private registeration plates which link to Z plus again hes used his own email own number and own bank details they have fully investigated this took them 2.5hrs to label this as fraudulent 

Secondly, the police git back I touch with me the case is with the domestic abuse team the lady officer dealing with it said there's enough evidence here to arrest him and do a house search she asked for copies of my credit report which I have given plus the company who said it was fraud asked for the officers details and vice versa so im assuming they'll be talking to each other too ...finally think I'm getting somewhere thank you for all your support and encouragement  x

@BankFodder I've received this letter through the post im a bit confused by the date they quoted I sent an email to aviva re the data protection yesterday and I've received this response so a bit perplexed part of me is thinking should put my case forward now as to how aviva have acted as now I've got someone whose taking this all seriously  any thoughts please ?

@Manxman in exile the ombudsman was dealing with the complaint ive not rejected decision yet as ive got an extension I sent a SAR on the 23rd April along with disclosure of the abuse policies they sent me a letter 5th May asking me to verify my identity on the 7th May ive emailed them on the lines of theyre creating obstacles when they have all my information and threatening legal action if I don't get the information in the 30day period  and today I've received this letter in the post 

Part of me is thinking I should email the person asking what complaint is she referring to and maybe put my case forward as now the CEO is involved

@Manxman in exile ik just as confused ive had no dealings with aviva since ombudsman has been dealing with ive only started sending SARs from 23rd April after I joined the group 

No idea what this relates to but I feel it would be a good time to put my defence forward and for someone to actually look at this case seen as its gone to very high senior management level as the CEO is involved

@Manxman in exile ive made no complaint to aviva I referred it to the ombudsman last march 2020 and its been with them ever since as I wasn't getting anywhere with aviva they had sent me their resolution letter back in Feb last year since then an investigator has been looking at it and then the ombudsman

I feel their maybe a glimmer of hope and I also feel maybe you guys can help me put a letter together to send to the ceo directly
