Help required urgently please - RBS charges claim

Hi there,

 

This is my first post on the forum so please bear with me.

 

I am in the process of litigation with RBS. I have received a CPR Part 18 request from Cobbetts to provide further details of the charges. I have now realised that the charges that I have detailed include agreed charges (royalties acccount fee at £5 per month) which I need to exclude from the claim. Can I change the particulars of the claim and how do I do this please?

 

I need to do this urgently as Cobbetts have stipulated a deadline for response of 13th December (ie I need to post this tomorrow latest) and I have received a questionnaie from teh cour which UI need to complete and retun by the 18th of December.

Yes you can. You need to contact the court service to amend your claim. It will cost £35 though which is not claimable.

hi post in the RBS section and read through some of the threads. i think you should be able to change it as long as you give all parties the new info. i hope a site helper will be able to help you more as i am is new to this

I have left a message witht the court to contact me regarding the chnage of details. Do I also need to contact Cobbetts, the solicitors, or will the courts do that on my behalf?

You will need to file an N244 form with the court, which you use with the amended details you need.

Sorry, jumping onto your query, however, see that you are claiming RBS.

 

I am just about to start claim against RBS. Can you please tell me if you contacted your branch in the first instance or Head Office in Scotland.

Did you apply for referral charges with RBS. I have listed them and was intending to put them with my claim.

I have indeed included the referrral charges. The difficulty that I had was that I included all of the charges to the account, which incorporated agreed royalty fees (non claimable), but as they are not separately identified, I am not sure what the original charges are?

I have not included interest charges, as I think it will be far too complex for me to work out as I was also in an overdraft position. I have also not included any monthly charges.
