    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm not convinced judicial review of the ombudsman is going to help Wellington much either, from what I've read this morning. It seems to be more about process than the decision itself. But I looked at the FOS database earlier and Wellington had the best part of a dozen decisions against them last year, so they would have an interest in challenging the ombudsman.

 

But some of this might be early because they're only meant to be talking about a set aside. I wonder if all the stuff about JR and other cases is to confuse things for the judge or if Ms Lozinska always writes like this.

Have you asked the FOS? Someone there must know, but you might have to be persistent to get to the right person.

Cross-border enforcement of judgments between Ireland and the UK has until now also been governed by the Brussels Recast Regulation. This provides for enforcement of judgments essentially 'as of right' between EU member states.

 

While the Brussels Recast Regulation generally ceases to apply to enforcement of judgments in or from the UK on 31 December, in practice the transitional arrangements under the EU/UK Withdrawal Agreement mean that the existing regime will continue to apply to the enforcement of judgments between the UK and Ireland for some considerable time to come. This is because the Brussels Recast Regulation will continue to apply in cases where proceedings were commenced before 11pm on 31 December 2020.

 

For cases begun after that date enforcement will take place under a combination, again, of common law rules and Hague 2005. These rules do provide for enforcement of foreign judgments, both in the UK and Ireland, but the procedure is likely to be more costly and in some cases less reliable than under the Brussels Recast Regulation.

Simmonds, I read the instructions from the ombudsman and FWIW, I thought they were pretty complicated, so it's understandable that you made an error. At least you're showing good faith  by paying to get the right figure and in any case Wellington were meant to be doing the calculation.

I don't understand all of it either, Simmonds but I'm sure Andy does.

 

Fwiw, my take on the last link, to the ombud's decision is that it's the same MO from WCFS as Mr R, your case and jcb's by the sound of it. First, deny the relationship and fail to provide any paperwork although there should have been a full process, written explanation and so on from Wellington for a SIPP investment. Then it turns out that they were quite happy to accept commission on the investment, as proved by bank statements.

 

After that, they claim they were stitched up by the SIPP provider and somehow it's all someone else's fault.

Do you know what the status of the Irish company is, Simmonds? I'm not wanting to cut across what Andy thinks, but in a way life would be easier for you if both companies close and everybody is able to claim from the FSCS.

 

I don't know if @Jcb2007has information on this at all.

I'm sure you will, Simmonds. Right is on your side but I understand that it's frustrating to wait this long for justice.

 

It's just a shame that Ireland has made it more complicated. I hope they take action against Wellington as well.
