    • Hey there, as the plane went tech you are entitled to the £520 x2 compensation under EC261. This is a clear cut case. Just claim straight with Virgin. However you are not entitled to a full refund, since you were eventually flown to the final destination; of course that second flight should have been totally free of charge; if not you must bill Virgin for it. Your mum+sis are also entitled to full reimbursment of taxis to and from the hotel, as well as meals+refreshments that they had for the entire duration of the unexpected stop, including both at the hotel and airport. (Just stay reasonable: no claiming for 49 pina coladas at the beach bar) Was their luggage returned to them during the unexpected stop? If not they may also claim for any toiletries and clothing that they had to purchase during the night stop. I understand the hotel has already been paid for, just don't forget the rest. Hopefully they have kept the receipts. Otherwise bank statements should do the trick. You need to claim for this in addition of the £1040 Other than the above there is no statutory compensation due for missing out on 1.5days of holiday. You could however talk to someone at customer service and make a polite request to extend your stay by another couple days and see if they will do it for you free of charge (providing they have space). Or if not, you could possibly get some token gesture of money back or voucher off your next holiday. It's worth trying. That you paid £700 for a name change is unfortunate but it's completely unrelated to the situation at hand. Above all I hope they don't worry too much about this mishap, and make the most of their holiday. Compensation is practically guaranteedwhen they are back. Just tell them to save all receipts they have and don't worry about the rest until they're back!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

IMHO I'd send the letter as before with the 8% bit added in, which isn't hard to adjust to suit. But, and as I have slight reservations, prior to this it might be a very good idea to pm one of the site helpers (eg. GaryH ) or an account holder with as much experience (Deller; The CobbettSlayer; natwesttookmymoney) for two reasons;

1. If you change your mind about going for the contractual interest how NatWest/ judge might see this (a cautious move, or weak claim)?

2. Not sure if by changing your claim for interest in this way that you'll incur costs to change via the court?

 

I'd be more than happy to help with draughting letter to suit, but I really think it'd be a good idea to get all the information before making a decision.

Letter sounds fan-blinkin'-tastic, but what concerns me is that you've had three site helpers advise you to take the money and run:confused:

I admire your spirit, not sure I'd have the guts, but I've got your back, dont you worry about that.:grin:

Me thinks the worst case scenerio is that you'll get your charges refunded at the very least:). Best case scenerio is that you'll get the lot:cool:

Hi muggs

 

Thanks for popping in and takin a look !

 

I have been going crazy trying to decide what to do and as you said I am going against advice of 3 site helpers

 

The reason for this I think ,is the way I posted made them assume I had been offered charges + 8% when in fact I had only been offered charges and was only at LBA stage

 

There was a mass sway against CI and many of us are confused as to what may be the right path.

 

But on the flip side I guess that people are still winning contractual claims, Westy and Cankster in the last day,so I think that if you are fully prepared and know the reasons behind why claiming the CI element, things should be ok.

 

I am going to make it my mission in life over the coming weeks to really cram up on the CI argument

Sorry to hear you are poorly, there's alot of it going around lately. My two youngest are ill again with this blasted cough that no one seems to be able to shift. It's the third time this month, and it's really beginning to take it's toll as I'm absolutely knackered.

Make sure you get yourself checked out properly, palpertations doesn't sound good to me, and more importantly try and rest a little. The N1 claim form part can wait there's no rush, you're gonna get your money back whatever...that should help you feel better:)

I'd wait and see how things pan out, no point in rushing.

I got my bundle partially together on the computer but didn't print it off. The likelihood is they'll settle before you need to go down that route but it's good to be prepared.

I also had a look at the AQ and downloaded the template, but that's just me being over organised!!!!

 

But, I figure you already know all this. Keep up the good work, you'll get there no probs;)

Update:)

Recieved copy of defence and AQ from the court this morning . I have until 8th May to get it to the court.

 

I will hopefully be posting a copy of my defence later today,with help from muggins !

 

I cant edit the scanned image on my pc so muggins has kindly offered to help me so I dont put my personal details out for every bod to see !

 

I feel that its really getting started now !

Haven't been round for a couple of days, family things and all that bother.

 

Looks as though you've got it sorted.

 

As for AQ, send it to the court and cobblers and keep one copy for yourself, of course. Not sure on cons regarding DDO, as I haven't had the pleasure in using it as yet, although I haven't come across anything bad about doing it yet.

It's always worth giving the court a ring to find out how things are progressing...or not, as the case may be. It certainly does no harm. The clerks at the court should be able to tell you whether or not the judge is looking into it and give you some sort of idea as to how long it'll be until you get your date.
