      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

..I've got to agree with ryde in that I'm interested in your opinion on inter-company assignments and transfers..

 

.. here's my situation for example:

 

1. take out loan with LPL ltd.

2. receive notice of 'legal assignment' to SPPL ltd.

3. some time later receive default notices referring to original loan with LPL ltd. and now with SPPL ltd.

4. a few months later still and default notices now say loan is 'transferred' to SPML ltd.

5. at some point between (2) and (3) a charge is registered at lr in the name of SPML ltd. using a TR4 form

6. on the claimant's particulars of claim they state that the debt was 'purchased' on a date prior to execution of the loan (1) and 'assigned' to SPML ltd. also prior to (1) with notice sent to the defendants also prior to the date of execution..

 

.. any thoughts?

still pay LMC D/D BANK STATEMENTS SHOW LMC

Only ever had one letter a year from LMC since 2004 a yearly statement on LMC paper which at the bottom says Lmc or a trading name of SPML

This is how I look at it

We should all stop talking the talk & set our dreams on what outcome we all want out of this,if we don't then we are just going to let spml carry on with what there doing & that is repossessions!! I think what ITBG is trying to tell you all is,don't just sit back & do nothing,do it for the people that have all ready lost there homes & for yourselves & your family.

I would like to comment on what I have observed from your posts thus far...

 

You have spent your whole CAG life asserting that Sue is right. That is your right, and no-one here is going to argue with your right to make a staunch defence of the equitable assignment argument.

 

You have no need to assert a) a well rehearsed argument or b) that people should seek legal advice. This is a pointless post in that respect, as most caggers and even the newbies would recognise that the legal profession needs an ever expanding base of new customers to advise , represent and then screw over.

 

In deference to Sue I would point out that throughout our differences it has rarely if ever descended into nonsense. However THIS is nonsense... not because it may or may not be incorrect but because it is redundant.

 

99% of previous Superslueth beleivers are now convinced of the following:

 

a) IT IS EQUITABLE AND THE LENDERS CAN JUST EFF US OVER, OR

 

b) IT IS LEGAL BUT JUST CAN't BE PROVED WITHOUT FULL DISCLOSURE OF ALL THE MATERIAL AND RELEVANT DOCUMENTATION AND AGREEMENTS

 

c) IT DOESN"T MATTER BECAUSE IT WON"T WASH WITH THE COURTS

 

The onus of proof is now on the defendant.

 

As clever as you are have you ever thought about the long term implications of this?

 

We already know that something in the region of 100.000 families have been dispossesed. (I use that term specifically).

 

We already know that a majority of these are based upon unlawful charging regimes and if not unlawful then nonetheless considered beyond the pale by the supine regulatory authorities.

 

JHC if the banker's friends are telling them to behave what does that tell you?

 

So what we have is this. A "justice" system turned upside down.

 

Guilt before innocence. Might over frailty. NO equity.

 

And a judiciary on the make as well. (witness the number of Deputy District Judges sitting in on repossession cases)

 

Accusation without a proper lawful foundation. Defence without a hearing.

 

What kind of system would YOU like to see in place? Or does the current system fit the bill perfectly?
