    • Hi there   thank you for the reply. No, it's not a silly question at all. I am convinced I didn't hit anything with my car. I was going very slowly and it was the guy standing next to his lorry in the road who punched and kicked my car as I went by. It's cause I saw him do it in the mirror.  I initially thought he did it because he thought I was passing him maybe too closely whilst he was messing around with his lorry ?  That's why I stopped and got out and asked what he thought he was doing hitting my car. He then just hurled abuse at me. Not making any accusations such 'you hit me' 'you hit my lorry' or you did this or that. He just swore and shouted at me. At which point I said I would be making a complaint to his company for his threatening behaviour and vandalism for punching my car. I went to my car , got my phone to take a photo of his number plate but then he came towards me again and I thought if he now hits me I am going to come second. I am a woman in her mid 50s travelling on her own and this guy looked like a Millwall football supporter (short, rotund, skin head) so I decided to leave this situation. I got back in my car closed the door and drove off before he could reach me.  I later checked my phone and noticed the photo was too blurred, as I turned and rushed back to my car too quickly before the camera could focus. So I thought it was pointless making a complaint as the guy couldn't be traced anyway, so I forgot all about it until yesterday. But this is all I can think of, it must have to do with this incident as it is in the same street.   
    • Please read the following thread very carefully. It is extremely relevant where you are suing Evri on the basis of a contract which you originally made with Packlink who are domiciled in Spain. A judgement has been obtained and we have applied for transcript and it will be put up on this thread as soon as we receive it probably about the end of July.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Looks like they have been in the s*** for years and have done nothing but restructure time and time again. Juggling the vast amounts of company names they have across the globe.

 

You can't tell me that Lehmans didnt know it was all going to go belly up years before it happened.

Going by that information, it looks like Lehmans may have originally been the bankers for SPML and ended up purchasing the business in 2002.

I conclude that any action by us, against any subsidiary of Lehmans is going to be too little too late.

 

Assuming there isn't a buyer then surely there can only be one of two situations. Either our mortgages will be managed by a trustee or handed to the equitable owners, if property/consumer /bankrupty law allows for that and continuation of contract. It seems at the moment that the 2 cases against Lehmans appear to be siding with the investors.

 

I don't know if anyone has read the background to the cases but overseas investors in Lehmans are using the UK courts because this is where the assets are held that they are laying claim upon.

 

It seems like only a matter of time before SPML and Capstone are no longer a player..It's possible that Capstone may run out of money before then.

 

I'm now beginning to wonder what rights we would have under the contract or as a claim? Would it be under a government fund? By the time PwC have finished there isn't going to be anything left in the kitty to even think about court action against SPML et al.

 

Does anyone have any thoughts on this or am I jumping the gun?

In normal bankruptcies if someone has an interest in a property the other parties are allowed to buy that share from the official reciever.I know someone who bought their bankrupt partners share for £1 because the property was in negative equity.Could this in any way apply here I would think the equitable owners have quite a large stake in most peoples properties.I would think the investors will de lever the mortgage portfolio from lehmans and then sell it on to another player to get as much of their capital back as possible or yet another similar operation may be set up under a different name but the best hope is that all this lot go into liquidation at least there might be some power of negotiation then.

I agree with you, if everyone just missed one monthly payment with Capstone/SPML/PML etc., the whole thing would collapse. As we can rightly assume(after speaking to the DTI), Resetfan Ltd and all its subsidiaries-SPML/PML etc are insolvent.

PWC would have to liquidate the entities, as there are NO funding reserves in the parent- Mable Commercial Funding Ltd is in adminstration.

I have no doubt, with SPML and over 100,000 mortgages, the Government would have to step in to rescue, or would face a backlash. This would stop all the repos and allow re-negotiated terms.

I once suggested mass none payment and got roundly condemned for it. Rightly so as well. It wouldn't work because there are so many out there who aren't even caggers and so would not participate. Those who did would be left hung out to dry.

 

If on the other hand anyone out there has substantial PR experience and could organise a mass none payment of say a 3 month strike, with the monies paid into a designated account instead. Now that would bring them to their knees.

If all these entities are insolvent as stated by ITBG,which makes sense as they have no back up funds to service their debts anymore only what is actually being paid in by the mortgagors as payments to the investors/bond holders(through the spv) and if they are not in administration surely they are committing a criminal offence by trading whilst insolvent(and should be reported but who to?) and being limited companies their debts will also become the liability of the directors?payments from the mortgagors at the current %rate may be nowhere near the %rate required to service the spvs because when the notes were issued interest rates were considerably higher(the returns promised to the investors needs to be investigated) so every day that passes means bigger liability for spml/pml and the like leading to one immense ever deepening black hole.Does this make any sense?

SPML and Capstone are not insolvent....yet. I guess it will eventually filter down..once legal cases are decided upon regarding the investors and unfair charges.

 

Withholding payment isn't going to help anyone least of all anyone that proposes to do it. It just gives them more reason to get your house and you risk being classed as making yourself intentionally homeless or possibly excluded from any future rescue/fund scheme.
