    • Well, that's it then. Clear proof of the rubbish cameras. Clear proof of double dipping. G24 won't be getting a penny. Belt & braces, I would write to the address LFI has found, include the evidence of double dipping, and ask Fraser Group to call their dogs off.
    • LOL. after sending Perch capital a CCA request with a stapled £1 PO attached (x2) Their lapdog Legal team TM Legal have sent me two letters today saying "due to a recent payment on the account, your account is open to legal/enforcement action" so i guess they have tried to apply that payment to the account to run the statue bar along. dirty tactics lol.
    • I have initiated the breathing space so ill wait. from re reading everything this what i understand BS gives me 60 days break from the creditors during these 60 days they may contact me and will most likely default I need to wait until after a default notice to see whether the OC will keep the debt or sell it off If kept by the OC then i should attempt a plan or pay some token payment? If sold to DCA then don't pay and after 6 years it will leave my credit report once the DN is registered with a date. DCA may start a CCJ but unlikely, if they do come back here. last question, do you know roughly how long this will all take? in terms of defaults/default notice, potential CCJ? Would you say I have 12 months plus from when the BS ends?
    • Well, it's up to you. Years & years & years ago the forum used to suggest appealing to POPLA, but then AFAIK POPLA's remit was changed and it became much more biased in favour of the PPCs. One of the problems with taking that route is that the onus will fall on you to prove your appeal, while if you do nothing the onus is on MET to start legal action which experience teaches they are very, very reluctant to do. If you go down the POPLA route I would think your ace would be insufficient signage.  Are you able to go back there and get photos of their rubbish, entrapping signs?
    • The first clearly visible sign as you pull in to the car park states “McDonald’s Customers Only 60 minutes” The next clearly visible sign is an almost identical sign outside Starbucks which states “60 minutes free stay for customers only” There are other signs towards the rear of the car park (away from the outlets) that have the terms and conditions on them in very small print.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have read your case history HSBC have also entered a defence on my claim for £4200 I was really hoping that they would not enter a defence and now I am quite worried I have heard nothing at all from DG solicitors, I am just going on the info on HMCS online. Any advice would be greatfully appreciated.

When did they enter a defence? I got my full offer the next day! The letter was dated the same day as they entered their defence! Duh!!

Boo hoo hoo... still no money.... I need help here!

 

The saga continues...... still no money into my account and just to make matters worse HSBC have charged me £150 this month!!!!!

 

Tried ringing Debs and Rachel, both answering machines, Debs not in till the 3rd, Im reallly hoping Rachel isnt away till then too. Ive left 2 messages with her, one today and one last friday and have had no resonse. I have a contact for a bloke but for EMERGENCYS only.....

 

So Im feeling really fed up and these charges have made me feel worse... dont they get it? They now say 'notified charges' does this make them okay? I want to start my next claim for charges from May to present date, looking at around a grand now but am worried they'll query this latest charge as its a new way of doing it. Its a worse way of doing it thats for sure, Ive never been charged this much in all my time with them!! Do you think I should start the claim?

 

And helps, hugs or support would be VERY welcome!! :(

Just because they say notified doesn't make them ok :( cheeky sods!!

I am about a week behind you (have been following with interest) and they were to debit £85 of charges from me so I rang them up and told them to refund it, they asked why and I said they are unlawful...blah blah blah.... If they were not happy to do it i would add it to my claim. Funnily enough they were only too happy to refund it then!

Can file for judgment on the 4th so hopefully will not be more than a couple of weeks now....

LOL I have gone all "charlie big potatoes" :)

 

I just rang up and said I could see the charges pending and would like them to be reversed. when they asked why I simply said because they are unfair and unlawful.......I think they knew at that point!

 

How long did it take you from defense til offer?

They sent out the offer the same day they entered defence! Duh! Checked my MCOL on the 20th, said defence next day got the full offer!! (They didnt wait until the 28th day with me which I think they do with most people!) But that was a week ago now and still no money!! Hopefully it wont be long now, xmas got in the way i think! Whats the bet new year will also get in the way!!

Have you sent your acceptance back, and also faxed same ?

 

Did you stipulate a 7 day deadline ?

 

remember you don't 'have to' return your AQ on the day stated, you can string it out a little !!

I didnt send it back, just faxed last Friday and have been ringing to make sure they received it.... my car has just dies, its off to car heaven tomorow...... it never rains here, just pours!! I NEED a car!! Now wheres my money?!!!!

 

I wanna file my AQ, or threaten to file it, to get them moving, how long does it take to put some money into my account and WHY cant I get hold of anyone!!!

Okay thank you, ill get them faxed over tomorow!

 

I know it will be tempting to accept if I get a lower offer but Ive told myself I wont! What happens if you say you'll accept it as part payment? Do they give you the money straight away or do they just wait and give you the full amount in one go at a later date?

 

wouldnt it be easier if you just included a shcedule of charges when you file the court docs, unless you cant do it that way on line, then surely it would be easier to do it in person with the shcedule

Erm.... thanks for the reply Steve! I did manage to speak to a man from DG earlier who was VERY nice! He said they have skeleton staff this week, him being the only one on his floor out of a team of 20! He said, despite what everyone says, they are very reasonable and very nice people and they usually get the money out within a few days but being xmas etc..... BUT as nice as he was he couldnt help as hes not dealing with these claims but said he'd try his best to get someone to call be tomorow!! :)

Hey all! A lady from the solicitors, didnt catch her name, called me back yesterday. Said that the 'request for payment' was being sent over that afternoon. Its up to the bank to deal with it from there. She said she has to say 7 days from then..... :( Could be less but says 7 to be sure... Oh whats the bet it will be 7? Probably more because of the bank holiday! But she did say it will be with me by the end of next week so Im guessing the 7 days included the b/h. She also said she had put mine to the top of the pile so to check the bank in a few days! But we'll see, def not getting my hopes up!

 

Anyway, the car has gone :( We put a deposit down on a car on Thursday, just nee the money to buy it now.... so I am without car next wee, the worst week it could happen! Im back to work Tuesday... would usually do an all round trip during schoool hols to get the little one to nursery and the 'big one' to a family member or the holiday club then myself to work.......usually takes me 45 minutes in the car, will be interesting to see how long it takes without a car!!! :eek:

oh thats not good. I think its because of the time of year. I need to phone my courts and tell them that DG have decided to pay out, so im in the same shoes as you. i will see what happens after new year. Might give them a call to see if they recieved my fax, and to see when payment will arrive.
