:confused: can anybody tell me is the limatations act different in scotland? if a debt occured in england over six years ago and a company from scotland are chasing it would there rules be different. please help as i was sure it was stature barred. thanks

Yes the Act is different in Scotland. If you are asking about the Limitation Act

on debts in particular, then if there has been a ccj [called a decree in Scotland] somehow applied to your debt by a Court in Scotland, then it

lasts for twenty years. If a decree has not been issued, then the debt is

unenforceable after only five years up North.

However just because a debt occurred here over six years ago, does not

necessarily make it unenforceable yet. For instance, a ccj issued within the six year period, would add an extra six years to the debt. Likewise, any acknowledgement by you or anyone else connected if the debt was in joint names, would start the clock ticking for another six years.. Simply by asking

about the debt is sufficient

to register an acknowlegement.
