      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

lets all remember who he is intending to sell this 'its all the EU's fault too ...

the idots who for some strange reason think he isnt unfit for any responsible position. and think he is talking sense.

If they believe that, they will believe anything.

 

 

I think we can all look forward to the shortest serving PM in history if he gets in.

 

Trouble is, a general election probably wont get us much better.

 

All we can hope for is a minority government propped up by the libdems - and lets hope they don't make the same mistake twice.

The libdems need to learn from the DUP and realise a small supporting party can largely run the roost in a limited number of areas that matter to them - as long as they are firm and hard enough.

So, either a Johnson ERG Tory/Brexit party coalition (why Boris might not be afraid of a general election) with Farage as deputy PM/senior minister

or a labour reluctant libdem coalition

after a Sept general election,

or (sounds like) Hunt

 

with Labour and Tory defections to other parties

A handful of Labour to the Brexit Party, more to the Libdems.

 

Corbyn gripping onto the Brexit doors for grim death against the whole Labour establishment now.

Long past the stage where you could trust Corbyn any more than you can Johnson.

The only difference is Johnson is clearly very happy to lie through his teeth, Corbyn will just obfuscate and avoid - but the result is the same

- both will claim - I didn't mean that - YOU misunderstood.

Although I hope what you say remains the case,

Just imagine Farage working with Johnson and agreeing a non aggression pact

Don't forget many Tory party activists seem to be refusing to campaign on anything other than hard  brexit

 

The polls show labour as potentially 4th in a general election, and with moderates at risk of de-selection by comrade corbyn, a jump to the Libdems would seem to be their best option.

Similarly with moderate Tories who may not be de-selected, but may lose their seats anyway.

Lets never forget that whatever else is happening - the majority of MP's want to keep their cushy well paid, inflation proof seats, and high risk of lost seat may tip them where conscience and sanity wouldn't.

 

 

The hard core of Brexiters will stay hard core - and its enough to make a difference with the weakness of Trot labour and Erg Cons.

 

The ERG hard right Tories and the Brexit Party are natural allies.

With all politicians, what they say often does not happen - sometimes despite their efforts,

trouble with Johnson as with all pathological liars what they say means nothing.

 

All you can be sure of with Johnson is that he will act in his own immediate interests and he WILL betray anyone and everyone the moment it is in his interests to do so.

If a general election is in his best interests - he will call one - else he won't.

 

Just remember the look of horror on his face when the leave win was announced.

Interesting article HB

I think there are a couple of seats where high profile Brextit party runners could win with no Tory candidate (but perhaps no Tory endorsement)

- one for Farage and a couple for a few others - Sold as a major victory gaining the Brexit Party a handful of MP's while giving the rest to Brexit promising Boris

 

.. not that they could count on him delivering anything he promised unless its in Boris' interests.

He be happy to betray them and just have a few Brexit Mp's as long as he had a majority

 

The big issue there is what would the Tory Party do if he failed to deliver.

Not a lot I other than noise I think.

I think its utterly definitive of the current situation in the UK that an apparently highly thought of, credible and competent civil servant is effectively forced into resigning for being honest and doing his job,

when unconscionable self serving liar Johnson not only gets away with blatant lying and NOT doing a good job, he's lined up to be the next PM

 

That the leak of the diplomatic documents was a political machination is pretty much without doubt.

 

That the Ambassador should resign after that leak is right and shows the Ambassadors quality.

That Johnson does not and would not shows Johnsons complete lack of quality.

 

This will no doubt be censored - but Johnson is undoubtedly the bottom dwelling **** even in  the UK's current political cesspool.

The really worrying thing is that Johnson might think he needs 'a bit of a war' to raise his popularity, and with Trump clearly wanting to escalate tensions with Iran, and the UK  having clearly shown its willing to do what he tells them (the boarding of the Iranian ship in International waters), he has a route.

Heres a thought.

None of us can see how Johnson can deliver anything of what he promises - not that that would ever be a problem for him

 

Neither can we see how he can remain in power with his stated stance

 

 

But he perhaps could stay in power by jumping ship to Remain as it does seem that Remain is now  a majority both in Parliament (once led) and among the wider voters.

 

 

It sin't jumping ship for him - its just the latest incarnation of Johnsons one man lifeboat.

.. and he will be aware that no one want Corbyn if they can avoid it.

(Corbyn is clearly relying on Johnson to get power)

 

Can anyone else see a route for him?

 

Heck - he could even end up in history as the man who saved us

The SNP + Libdems can't call one,

and Corbyn wont unless he's forced into it - he wants Brexit before a General election

- and few think he can win anyway - even against Johnson

 

Bl**dy farce.- which is entirely appropriate as the court fool now has the crown and there's something at least as bad waiting in the wings.

 

 

We had Cameron, and thought - its got to get better

Then we had May, and thought surely it can't get any worse.

1. Parliament does NOT want a no deal

2. Johnson has NO mandate from the electrate

1. is unlikely to change apart from getting more out of Johnson Favour

2. Depending on which pole you believe - the country is getting more (perhaps VERY significantly more) in favour of remain.

 

 

Whats in Johnsons favour

1. He's uniting the Brextiters, at the Brexit parties expense, which Farage is probably in favour of.

2. Corbyn.

3 The split Remain vote between Labour/Libdems and Greens

 

So with Corbyn an obvious Leaver - that plays into Johnsons hands,

and if Corbyn is forced to come out as remain - few would believe him and it still splits the remain vote in a general election scenario

I think channel 4 news is perhaps the best, most in depth honest reporting service we have.

 

Far better than the BBC or Sky,

and when you consider trash rags like the Express and the Mail - which should be considered as almost exclusively party political broadcasters like RT ...

Well I hope it wasn't the guardian or channel 4 news,

else its likely to be supported by significant evidence, although of course there could always be a little doubt..

 

I trust it was on fox news, or Breitbart or the Mail - in which case only right wing Brexiters would believe such unsupported rubbish,  alongside such tosh as 'Johnson is a man of his word' and 'Trump is a good president'  - so no-one in their right mind would believe it.

 

IF you care to give us a link - I'm sure we'll quickly see what rubbish it is.

You haven't shown us what monstrous crime against humanity/the animal kingdom/natural world one of the lying right wing rags has falsely accused you of.

 

Despite the unadulterated daily lies of rags like the express and mail and breitbart/fox news, and your obvious horror at the claims, It is clear that not all news services are like them.

 

Some, like the Guardian and channel 4 news undoubtedly apply fact and evidence based quality reporting - although as previously stated - mistakes do very occasionally and rarely occur even with them.

 

Don't allow your horror at the claims of right wing, lying, sensationalist, low brow rags drive you to tar all with the same brush

 

 

Give us a link and I'm sure I will be able to quickly highlight the complete lack of credibility of at least some of the associated claims.

They should be taken to task.
