      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just got back to a letter from HSBC, all the usual guff - not our fault, you shouldn't have gone overdrawn, our charges are well publicised yadda yadda yadda

 

BUT

 

We are willing to settle with you now

 

FOR

 

90% of my claim!!! :D :D :D

 

I know I should go further and try to get the lot but to be quite honest I am so very, very happy to go with this and for the sake of £130 plus then the 8% I am going to stop here.

 

So I've just been and bought a bottle of bubbly so if you'd like to raise a virtual glass to the Consumer Action Group! - cheers

Just out of interest, would you settle for 90% Babs? Just wondering really as I know we should really go for the whole amount, but with Christmas coming up and three kids to buy for and we're trying to sell our house I don't think I've got the energy if you see what I mean

Hmm well as you know I've already done the MCOL and with all the charges and interest and stuff it adds up to £5976 but my original claim was just over 5k. See if I hadn't just had to borrow the court fees and I didn't have Xmas coming, and if if if ........no I prob wouldn't.

I think it'll depend on when they send the letter of offer, if its soon, then prob no and I'll bank on still having the money before xmas....if it's not for a few weeks then prob I'll settle. That does make me feel bad and its tech not what the site is all about so there is the moral dilemma there too!

 

I think I'll be better able to answer that when/if I get an offer.

Yes, I know what you mean but as you've filed and its been issued then technically you should be getting the money in time for christmas as long as they don't start playing silly beggars, which lets be honest with that amount they shouldn't but you know what HSBC are like

 

It is a moral dilemma and I know it says everywhere not to settle but you know sometimes you've just got to go with what you feel is right if you see what I mean?

 

But yes, will still be around, I think this site is fantastic and I've sent so many people over here and I really want to see how you and Jayne and Steve are doing - want to raise that glass of bubbly with you all

The one thing that does seem completely baffling is that HSBC seem so random in offers & settlements...You'd think they might have a standard policy now with all these claims, some go to MCOL & they defend, or not, some receive offers to varying degrees, but none of it seems to have any rhyme or reason. Very odd!!:-?

Babs - unfortunately it has all been eaten up already in other debts and bills but I did have enough left to get a bottle of bubbly for Saturday night and it does mean that we can buy Christmas Presents from our current account and not on credit!! lol!!
