    • All of the services listed in the upload link to convert to pdf and/or edit pdfs are online, which means you are uploading your documents to another's servers for the merge, and whilst some claim to delete the files within a given timeframe, we have no method of validating this. And so I avoid this, as I do not want my personal and often sensitive information to be in the hands of another. I'll upload to my website and/or one-drive and provide shareable links instead, this way, I remain in control and everyone shall be able to access my documents - there's much, much more than just those two
    • If you simply respond to the NIP and request for driver's details promptly the police will simply process it in the normal way and either offer you an out-of-court disposal or take court action (and which of those will depend on the speed and limit and your eligibility). They do not routinely ask for proof of insurance and there seems no reason why they should do so in your case. £300 and six points is the fixed penalty amount for no insurance. It can be more if the case goes to court. There is provision for n unlimited fine, up to eight points or a disqualification.   That is all as far as the penalty goes. However, you should not dismiss it too lightly. An endorsement for No Insurance will probably double your insurance premiums in the first year. As well as that, if you also have one or two speeding endorsements, the increase will be considerably more. In fact in those circumstances some of the mainstream insurers will refuse to cover you at all and you will have to go to a "specialist" (which means very expensive) broker.
    • I think we normally recommend people to follow the upload link
    • I removed them as they have my email address on them, and so shall repost them once my Snagit scrolling capture thing starts working (needs reinstalling I think as it keeps falling over); they are an email that runs over two pages, so would be best suited to a scrolling capture. As for multi page formats, this is harder as I have no tools available to merge documents, unless you can suggest any free ones that will perform offline merges without watermarking
    • Oh that is very helpful, thanks a million for answering my query. Looking at the license right now. At the front it says the issue date is 2022 (that's when I swapped it), but at the back it says 2015 next to Category B. So, I'm definately at 12 points, right?

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been repaying my MBNA Credit Card account via Stepchange for some time now, and MBNA were happy with the amount I was paying and, in that respect, my account was up-to-date

On the 19th August I received a latter that stated "We are writing to give you notice that we are ending your MBNA credit card agreement in accordance with Clause 18 of the terms and conditions. This will happen on 22/10/2016

The letter then goes on to say that if they sell the debt to a 3rd party, they will tell me "as soon as is reasonably possible"

I get home today, 14th September, and my latest statement from MBNA is on the doormat. I open it to find that they have already sold the debt, and this was done on the 8th September.

My question is, having given me notice that this wouldn't happen for another month, and they would tell me ASAP if it was to be sold, are they within their rights to do what they have done? eg terminate the account a month early and sell without telling me first?

Just seems very underhand to me. Being in debt is stressful enough but behaviour like this just makes it worse... Out of all my creditors, MBNA have been the worst by far!

IMO, you're in a better place now than when you were paying them a reduced amount.

The fact that they are flogging it would suggest that, they have taken what they know they are legally entitled to, and are now passing the remaining toxic part of the debt off.

How much of this is charges or reclaimable fees and interest?

How much have you left to pay on this?

When did you take this out?

Hi,

Thanks for the reply but I'm not clear how I'm in a better place? I would rather deal with the lender than a parasitic DCA!

Very little of the debt is made up of charges and the interest was significantly reduced when I went on to the DMP with Step Change.

I took the account out in 2008, got into difficulties in 2014 and have been maintaining regular payments via the DMP ever since which they have been happy with.

Current balance outstanding is £2,933 and I was repaying £89 a month.

Interest reduced??

Interest should have stopped all together!

On the contrary, if the OC has been happy in the past, and now they are flogging it off, then the powerless DCA can jump through all of the hoops you put in front of them and pay £1 a month.

Was this the only debt you had in the DMP?

£89 a month seems steep!

No.. I went into the DMP with just under £50k of debt ( I had a messy divorce and went off the rails financially a bit ). I have a good income which is why my DMP payment is quite high ( over £800 pcm )

The majority of creditors haven't defaulted me, including MBNA, and I wanted to keep it that way. Indeed my credit report shows the account as "up to date" albeit with an AP marker. MBNA confirmed only 6 weeks ago that the account wasn't in arrears!

Since 2014 I've repaid just over £20k of the debt so am getting there slowly...

Excellent well done, you;re doing well then.

Although the AP marker is just as damaging as a default TBH.

So, you had an agreement to pay MBNA and now they are reneging on that agreement and breaking it?

If they are in the DMP, then they get dropped, and revert to £1 a month IMO.

A default on your CRF lasts six years then drops off, never to return, paid or not.

Who are your other creditors in the DMP?

What does clause 18 say? Seems unreasonable to me. You are doing everything you can to pay back. You are not behind under your new agreement..Yet you end up with a marker ?

The DCA only want to be parasitic..they have no power.

I've attached my latest DMP statement with the personal info removed..

Hmm, I'm now thinking looking at that, that there might be some irresponsible lending?

How close were those PDL's taken out?

When was that Tesco card taken out?

I don't condone paying a powerless DCA, especially Robbersway, it simply gives them profit to harass and bully others.

Hi,

Thanks again for the reply and your insight.

Tesco Loan was taken out in 2009 I think. Defaulted in 2014 and sold a couple of months ago, despite my being in an arrangement to pay with them which was up to date. Strangely, this account doesn't show on either Clearscore or Noddle anymore...

I tried the irresponsible lending route with the PDL's, Lending Stream agreed and wrote off £500. The others told me to go forth and multiply...

Given I'm going to have this DMP round my neck for another 4 years nearly, at the tune of £806 a month, I'm wondering if there's any way I can speed this up / reduce what I owe quicker?

I've got a bloody good final salary pension I've been paying into for over 20 years but I'm not 55 for another 10+ years so I assume that's not an option to tap into?
