Right - did some more thread reading. My mortgage with these people closed approx 2 years ago and I no longer had details. So on advice supplied on this forum I popped in today and provided proof of identity and address implying that I had been asked to do so over the counter. All information supplied without my having to mention Date Protection Act.

 

Sending it all off tomorrow with RM 'proof of posting' whatever that is. Glad to be informed it is free. Oh, and £10 fee naturally. 2 started - only another 9ish to go.:|

Hi - take a bit of time to read up first to make sure that you have the facts before going too far ahead. Read the FAQs and template letters then have a good read around here to see how others are getting on.

 

Keep any progress on your own claim or questions that arise in a new thread in the forum for your bank to make it easier for others to follow and advise you. There's a set of links in my sig below that will help you find where all this useful information is. Well done for getting started! :)

Thanks for that. I did read quite a lot of threads when I first joined up 2 weeks ago and I look what is happening to others most days. Silly question coming up - do I start a new thread for every claim? Seems silly to put everything under Halifax. I notice you and others have claimed more than 6 years. How is this allowed?

Gosh it is starting to happen. Acknowledgment letter popped through the letter box this morning. 35 days for them to comply. Still not sure how far back in time I can go. I presume it is 6 years. Payday soon so I will be able to buy suggested books.;)

Rang them up this morning politely asking where info is as cheque cashed 2 weeks ago and pleasant girl said she is going to send my info out this week. Then I'll be back here asking for moral support/having a blond moment I expect.

Most of the charges I can cope with:- arrears fees, debit interest adjustment etc. BUT can anyone give me some guidence on the following?

 

Debit interest adjustment which was £0.01 31/03/01 but 12 months later totalled nearly £2500 due, I assume, to arrears fees etc. Can I really claim these debit interest charges or is it just a fancy way of adding on the interest they are legitimately making from me having a mortgage with them? Seems odd it does not appear till 2002..........

 

On 07/02/01 there is an entry "Costs £722.50". Can I claim this?

 

I have read (but must re-read) link about claiming early redemption fees as I got so fed up with them I moved my mortgage to the Halifax. And I thought a mortgage one would be an easy one to start with!!!

I'm going to have to stop for today. Have only just read Seminole's guidence notes and am now blown away with being able to go back 12 years - and yes they have sent me all this info. Glad I am no longer with them. I seriously doubt if it will be less than £5000 now so I presume I just claim twice, but there is no reason why I cannot claim Early Redemption Charges with my 2nd claim - is there? Just adapt letters. Sorry to ask so many questions - you did say it would be all right though:rolleyes:

Start a new thread in the Mortgage section where we can help you more. If you add on any interest and it goes over the £5000 you may be able to ask the judge to keep it in the small track area. I can help more when you start the letter writing and get responses back. Have a good look around Zootscoots posts, and Zoot vs Halifax for more information. I have posted a defence on mine which came about 5 weeks ago from the Birmingham Midshires, so it will give you an idea of what to expect. Don't worry you will get plenty of advice. It may be an idea to claim for the ERC separate, that way you may keep under the £5000 limit for small track.
