the 14 days of the lba have expired and its off to money claim.

 

ive filed out the particulars of claim before for my partner and now need to do my own.

 

i need one bit of guidance though.

 

im claiming for both my closed current account and my current credit card. i have a feeling this is going to be a sod to fit in???

 

1) do i add both claims together?

2) in the bit " i have a contract with the defendant bank" do i put the date when i opened the current account only or both??

its about £1292 plus 8% interest (cant open spreadsheet on work computer) so ill have to work out the total in the morning

 

havent looked at the n1 route as yet,, thanks for pointing me in the right direction.. grrrrrrrrrrrrrrr work computer cant download pdf so that will have to wait till the morning as well..

im claiming

 

£735 + £137.93 interest on halifax credit card opened 08/12/1997

£560 + £211.84 interest on current account opened 05/05/1992(now closed)

 

in particulars of claim do i combine the 2 using the 1992 date as when i first had a contract with bank. then for the bit about interest add the 2 figures together.if so do i have to state anywhere there are 2 accounts combined and how would i word it???

 

if so it obviously wont fit in the particulars of claim if i use moneyclaim therefore i will have to use a n1 form.

 

or if i have to keep the dates and figures separate once again ill have to use a n1 form and how would i word this.

 

 

 

ive already gone through moneyclaim for my partners claim but this is confusing me having 2 claims against halifax

You can list both accounts and their opening dates on Form N1. When you reach the Value section you can put in two sets of figures (one for each account), plus a grand total for the claim and a single daily rate of interest.

i went into halifax today to get the date when my old account with them opened. the woman asked me why, i told her it was needed in my claim for repayment of charges as ill be going to court on monday. im only going down the court to drop off n1 form but she said "really, but i was told they are not going to take anyone to court". i smiled and left after being told the date :D :D :D

today i received from courts the issue of claim telling me halifax had until the 9th to issue a defence... no doubt it will turn up on the 7th or 8th then!!!!

edit.. im seeing that lots of people are being paid out... my claim is for a closed current account and my credit card.. will they send a cheque for the closed current account and will they deduct the other amount off my credit card balance???
