      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys,

 

I have a car on finance and

 

due to moving I have not been able to get letters for the car and

apparently I have missed 2 payments,

 

I had a phone call today from a 'warrant officer' saying the finance want the car back immediately

or the full balance and the finance company is failing take my calls.

 

I spoke to the warrant officer and

 

they said if I don't give him the car he would report it stolen to police who would arrest me?

 

He also said I could get up to 7 years for it!!

 

Surely this can't be right..

 

Also I am not refusing to pay or give the car back

as originally he said I have a week

but now I don't for some reason

and I though a week was reasonable to get it sorted.

 

Any advice much appreciated and if you need any more details pleas let me know.

Ignore the silly muppets. They wont do that and the police wont do anything. It's a civil debt, not a criminal one.

 

Can i ask how much you have paid off? Is it more than 1.3?

The total finance is 7300 and the amount paid to my knowledge is around £900 so I'm still quite early in the finance agreement and the finance company won't take my calls so I can't change my address or discuss it directly with them.

I only found out today about the situation as I was driving and had a missed call so

 

 

I pulled over and rang back to find to my surprise it was a warrant officer,

 

 

he seemed reasonable at first but I told him I was busy driving back and my phone was low

and I'd phone back after I'd spoken to the finance company

but they refused to talk and I phoned him back and his attitude changed.

 

Now I said to him I may be able to settle the remaining balance but he said they'd want the car impounded for a week first

and that he'd get it out on police ANPR if I didn't to seize and arrest me, due to this threat I've stopped driving on motorways.

 

I've checked my bank and there has been no attempts made to take my monthly payments

and I had it setup as a direct debit so there's no reason why the payments could've been missed.

 

Also something that worried me is that he found me on my personal facebook account

and was saying I had a picture of the car on it?

Not sure why they'd do that.. :(

Warrant officer? Huh? Do you mean a silly muppet at the finance company? If he did report it as stolen, he would be in deep trouble as the car isn't stolen at all. It is on finance.

 

Can you give more details on this finance company and this "warrant officer" person?

The company he said he was working for is called Anglia UK ltd

and he phoned me on his personal mobile as I googled it to find out more information about the company

and it shows a lot of his own personal things and forums etc online

Anglia are a no powers repo company they ARE NOT BAIIFFS AND NEVER EVER WILL BE.

 

 

pers I'd ring him up

and record the conversation

getting him to state the warrant officer bit.

 

 

that'll def get them closed down.

have you not got a recorder on your mobile?

 

anyhow

 

have you got the agreement?

 

when did you take it out?

look on the back

 

if you paid more than 1/3rd he cant do anything without a court order.

ok

so you've only paid £900 of a £7300 agreement

 

is the car listed on it please

 

you need to write to satans bank

tell them your new address

 

include your intended dates for getting the payments back inline

with the agreement.

 

if the car is mentioned then the repo guy can take it from the public highway

but not from you private drive.

 

they typically only start this action after three missed payments

 

and they need to have sent to a default notice first

 

but ofcourse as you've failed? to tell them your new address

or that you were moving?

they've poss sent them to the old address
