      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Almost every day for the past week I have received automated calls from 1st/first Credit asking for a woman I don't know to ring them. So far they have only rang when I have been out of the house, so they left automated voice mail. I have had my land-line for a while and I get calls for this woman from a different credit provider/debt collection agency every 8 months to a year. It seems that whomever this is repeatedly gets credit and gives a false phone number as according to my phone provider she has never held my number. She doesn't use my address and I have checked my credit rating in the past, so it it just irritating phone calls. Up until now all the agencies and credit providers I have answered the phone to have listened to me and not called again, which I know I have been pretty lucky with.

 

This current lot have only left automated messages and from what comes up on Google they seem to be a bit dodgy. I don't want to ring the number as they are just going to assume I am the woman they are after. I'm not sure whether to try and write to them to tell them to stop ringing without giving them my name or address, or to just ignore it until I get a human on the phone. I don't have a phone with caller ID so I can't tell who it is going to be before I answer it, so it is a bit hard to ignore.

For your sanity, i would call them... Advise them that you are not the person they are looking for...

Now record the call. If they continue to call then you inform them once more by sending a letter before action and that youll be referring the matter to court. If you do the second step... Follow it through.

Don't entertain them over the phone.

They won't listen or even care, you'll be wasting your time.

 

Get in touch with your phone provider and go through their malicious calls procedure.

Keep a diary of events regarding their calls, if you know who they are send them a letter informing them that you will seek legal advice should they continue to harass you, with a view to taking legal action as well as reporting them to the police for the criminal offence of harassment.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Thanks guys! They've only phoned once since, leaving the same automated message. If they ring again next week I will send them a letter telling them to stop and talk to my provider to see what they can do to block them. I've made note of the dates and times of the calls also. If it doesn't stop I'll send a letter before action.

Ask your provider to change your number should be free as you are receiving nuisance calls.
