    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My wife an I complained of miss selling PPI on several accounts we held jointly and individually ( in 2006 me having had a bankruptcy my wife was not named in) there latest response to my wife only reads

 

 

"The complaint can only be made by the primary account holder with a signed authorisation dated to within the last six months. As you are the joint borrower for the loan to which the PPI complaint refers to, there fore we are unable to register your complaint"

 

 

I take it they want me to authorise them to deal with it towards my wife solely.?

They go on to say

" Upon receipt of the above documentation we will proceed with the complaint."

 

 

Any suggestion on what my reply should say would be worth a donation to this site.

Yeah you're probably the insured party (most loan PPI policies only covered the first named borrower). A letter from you giving your complaint reasons and asking that they deal with your wife in respect of the matter should do the trick.

Thanks for the heads up, it confused me and I was reluctant to call them as i felt they may try to take advantage, your experience has given me the confidence to contact them by post.

RBS PPI update thankyou andybars and Hortz sent them a comprehensive letter encompassing my complaint on several leves l today ten days later received four separate letters one asking for a valid sixteen digit credit card number to enable processing,another saying the policy I complained about

 

 

has already been registered with a ref no.,the next talking of me not providing a valid Lombard account number to enable processthe last then saying the investigation using all known details of me found no record of PPI. The most significant problem I have was destroying

 

 

all old paperwork as some sort of healing process (which I wouldn't recommend as it did little for me as per usual)

 

 

I can sort other peoples worries out and not great with my own at times, trying not to appear ignorant am I correct through other reading on here need to request a SAR from them. Requested to bring my concerns to them by post Jan 2012 and this reply sounds positive,

 

 

 

 

been to ill to preserver until now, the period concerned is 1999-2006 my phishing has got me thus far, I just never give up.

I have just had an offer of PPI refund from RBS of over £20k. This I started by sending a SAR as I had over the years lost or destroyed most of the relevant paperwork. What I got back came in three separate envelopes and was quite thorough and gave me virtually all the info I needed to make a claim which as above was successful. The SAR results RBS sent me were quite comprehensive and went back to the mid 1990's. Not every statement was included with the odd one or two missing here and there

(a few for each year) but the bulk of them were received. I do think, from reading other threads, I was very lucky in the quantity I received, but I did find RBS very cooperative. Good luck.

I have two pending complaints with RBS - one for RBS ADVANTA/MINT and the other with RBS Mastercard. Will I have to submit two separate SAR's ?

Finally got three offers from*RBS

Thing is at the time 8 years ago I had debts with them caused partially by the PPI failing to protect me*

when I became permantly disabled.*

 

Can I use the case of making sure they try to return me to a position financially before I took the PPI,

claim against them for failing to protect me when I had my accident*

( as the disabling injury was to my back and had minor back problems preexisting)

or ask them to pay half or all the money to my partner.

 

I am in disbelief as for three years they denied PPI was ever taken out*

one is for £850*

the next £380 and

the third £425.

 

I was treated very badle back then and have lived in poverty ever since.

 

All the credit cards and loans deny PPI*

can a*SAR

icon*work well for them.*

 

Through following advice on here wheels are finally turning*

so thank so much.*

I intend to*donate

icon*futher if this money ever materialises and this wassnt just a paper exercise.

 

I would love the chance to get them in court if need be.

I am aware that RBS do chase acceptances by text, You should however deal with their letter in your own timescale not theirs, particularly if you think its incorrect. The only important timescale is that if you want to take the case to FOS you must do so within 6 months of the letter date.

I put payee natwest as my b/ac was natwest. Not sure if RBS will accept it to release my SAR docs been almost two weeks still no show?
