    • Hello , sorry of this is in the wrong place. I have received in the post a County Court Claim claim form.  This relates to MYJAR and issued by TM Legal relating to a payday loan issued 11/2017, subsequently they issued a default notice 09/2018. The debt isnt on any credit reports.  4/4/2024 I had an email saying a Letter of claim was sent - this was not received , i replied to say I believed the debt was statue barred their response We are aware that the correspondence you have sent, is in a format that is circulated on consumer-based websites whereby debtors are encouraged to use the templates in order to avoid repayment of their debts. We do not accept that the contents of these templates bear any particular relevance to your case. For clarification, in line with the Limitations Act 1908, no claim may be brough after a period of 6 years from the cause of action. The cause of action in this instance is the Notice of Default served upon you by the original creditor on 24th September 2018. As such, the account is not Statute Barred. 10th June 2024 I have received a county court claim form and now i am unsure what to do next and how to complete and respond, I do not want a CCJ. Please help

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

This is my first post so hello to you all and hope you can help me?

 

In April 2004 I went bankrupt as i had quite a large amount of debt and couldn't see any other way out. In December of the same year I was discharged.

The issues i need advice on are as follows:

 

1. One of the accounts included in my bankruptcy was with the Funding Corporation, I have had nothing but constant harrassment from them for the money that I owe them (or did owe prior to going bankrupt). They constantly pass my account out to debt collection agencies and they refuse to answer my correspondence asking them to cease to do this. I have sent them my bankruptcy certificate and discharge certificate on numerous occasions, the Official Receiver has also contacted them on numerous occasions, yet they still continue to harrass me. In addition to this the date of default they have registered on my credit files is 14 months AFTER i was made bankrupt, that is even after i was discharged! How can i possibly default on an account 14 months after it was included in my bankruptcy? Also, the FC have not marked my account as satisfied or partial settlement and still show the full outstanding balance. I have contacted the Funding Corporation about these matters but yet again they have ignored my letters and refuse to listen to me when i ring up and speak to their advisors.

 

2. My second query is regarding another account included in my bankruptcy, this was with HFC Bank. My credit files all show that i still owe the full balance on this account, again like my account with the Funding Corporation surely this should be marked as Satisfied/ Partial Settlement? I have contacted HFC regarding this matter but like FC they have chosen to ignore me.

 

3. My third and final problem is with Equifax. Even though i have informed them of my discharge they have entered this discharge on my credit file as a 'Notice of Correction'. I am led to believe that this can have a detrimental affect when obtaining credit as it stops automatic credit checks carried out by banks. I have written to them but they refuse to change this, the other two CRF agencies can manage to record this correctly... why can't Equifax!?!

 

 

I believe that these matters are affecting my chances of obtaining credit. I currently have a secured credit card from capital one (i paid £200 for a credit card with a balance of £200) and a basic bank account with barclays. I would like to upgrade my bank account with barclays but have been refused because my credit rating is too low, undoubtably the fact that the wrong information is on my credit file is not helping!

 

My apologies for the long winded post but would be extremely grateful if you could offer some advice or point me in the right direction.

Although Andyjay says he believes these matters are affecting him getting credit handyandy, he doesnt say he is trying to get any. What he is asking is like many of us on here, is advice from people not judgement.

It appears he has been through the mill recently and Bancruptcy should never be taken lightly and is finally trying to get back on his feet. Comments like yours should be kept to yourself no matter how you feel about something, this is not the place to pass judgement, misguided or otherwise, if you have any advice to offer him then by all means do so but dont slate him for trying to sort his problems out?

So what you are trying to say is that i should continue to let a company harass me for money that was included in my bankruptcy from which i am now dicharged!? And that i should also let companies record the WRONG information on my credit file?

:x NotSoHandyAndy i resent your comments. All i am trying to do is upgrade my bank account and feel the fact that the wrong information is recorded on my credit file is not helping me. I'm not trying to obtain loans or any other sort of credit, i merely want to improve my credit rating as best i can as soon as i can. I didn't exactly go bankrupt for the fun of it and i certainly don't want to do it again. Comments from like you get up my nose.

Not sure how you can stop them - but there must be some remedy - suppose if you let them take you to court they can explain to judge why they are still chasing a bankrupt debt. As you have tried all the normal things that would be suggested then I guess maybe take them to court for removal of the default - one that was registered after BR that may clear it up - but you need to check out the legalities of that - sorry can't help more.

Thanks for your advice. Do you think that perhaps the ICO may be able to help? Whilst the harrassment is distressing i can put up with this because at the end of the day the debt was included in my bankruptcy and therefore the FC have no chance of getting any money off me. However, as the date of default is recorded 14 months after my bankruptcy this means that it will still be on my file after my bankruptcy has been removed, obviously this will have a detrimental affect on my credit rating for longer than it should do.

They simply say oh its cos we have so many people going Bankrupt these days that we have to get it from somebody as the who declare themselfs bankrupt just wont pay a single thing back.

 

So i raise my glass to +********* like you andyjay and say thanks for the cr+*+*+*+* financial world we live in, I hope you get your bank account and credit cards back cos people like you will never change.

You know abosultely nothing about my reasons for going bankrupt so i suggest you keep your opinions to yourself. I didn't go bankrupt just to get out of paying back my debts FYI! You have no right judging me based on your obvious contempt for bankrupts. Maybe the reason banks quote you such high interest rates is because they know your a

What makes you think i don't have a house and need money you There you go again making incorrect judgements. I can't stand cyber heads like you who mouth off from the other end of a computer. I find it funny that you resent me for going bankrupt and that its somehow my fault you get charged high APR for finance... perhaps its something to do with the default your trying to get out of paying? I hardly think having defaults on your credit file helps your credit worthiness.
