    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.
    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address
    • If it doesn’t sell easily : what they can get at an auction becomes fair market price, which may not realise what you are hoping.
    • Thank you. The receiver issue is a rabbit hole I don't think I'm going to enjoy going down. These people seem so protected. And I don't understand how or why?  Fair market value seems to be ever shifting and contentious.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Maybe negative reps could be turned off? I don't see the point in them, just positive ones, so you either rep someones post positively or you don't rep at all? We've got the report button for seriously dodgy posts

What is happening with reps? Yesterday (day before that now) it showed how many points each persons rep was worth. This was on all of the posts. Today, this has disappeared and I have lost points and 2 reps that I had received. Looking again it does say Latest Reputations so maybe they just drop off after a while. I was proud of my reps:cry: Saddo that I am :p

I do! Look how many posts I have made! I don't understand how this works at all... :(

OK... if people like your posts a lot they will click the scales and select "I approve"... as they do this more and more your green bar will build...

What's your reputation score at the moment?

Link to post

Trouble is, Newbies, n00bs and generally people who haven't been here long click the scales a LOT... but they don't have any "Reputation giving power". That means that their little dot next to the "latest reputation given" is grey - and they don't affect your score. What you need is to impress the old hands, people like me for instance ;)

I just gave you a rep; has it affected your score?

Register Date Factor

for every 40 number of days, users gain 1 point of reputation-altering power.

Post Count Factor

For every 40number of posts, users gain 1 point of reputation-altering power.

Reputation Point Factor

For every 60 points of reputation, users gain 1 point of reputation-altering power.

Minimum Post Count 50

How many posts must a user have before his reputation hits count on others?

Minimum Reputation Count 50

How much reputation must a user have before his reputation hits count on others?

Daily Reputation Clicks Limit 5

How many reputation clicks can a user give over each 24 hour period? Administrators are exempt from this limit.

Reputation User Spread 10

How many different users must you give reputation to before you can hit the same person again? Administrators are exempt from this limit.

Has this changed?

I am curious as I have green blobs from people who have only made a few posts - not grey as previously stated. But no points added.

Also a couple of points added from people who have made about 10 posts (not 50 as stated above)

I would also like to know what my point giving power is? I make it about 12 going on days, posts and rep.

Oh and why are some of the green blobs on here bright and some dull?

Also, what does it mean when the bit which has "posts, location, blobs" etc is blank except for N/A?

I understand Husbandkhans but I have seen someone saying they are a newbie with the same thing.

sal, when it says N/A it means they have asked to be removed from the forum entirely. posts advice given apart from bear garden posts which count for zero, some people have no posts at all because they have registered used info or potentially have links to certain organisations.

Blobs, i give in on.

Well I can clear that one up for you.

You receive ONE green blob for each 100 points of rep you receive up to 500 points.

After that it takes 200 points per light green blob up to 6.

So in the end you would have 5 dark green and 6 light green blobs for a total of 500 + 1200 = 1700 points.

You are awarded points when another member clicks you scales.

Now the formula behind the size of this award is very complex with a lot of variables, but I have noticed that Mods give around 20 rep per click and other members give varying amounts depending on post count, age of account and the number of greenies they have.

Hope this shed some light on this part of the site.

Ps I use the same forum software on the site I admin hence the in depth knowledge of the rep system

I forgot to mention that the Black square mean that the member has diabled rep display.

They can still give (hint) and receive rep, but the greenies aren't displayed at all.

I'll summarise for you.

Basically.

reputation_pos.gifreputation_pos.gif = 100 points

reputation_highpos.gifreputation_highpos.gif = 200 points

So the more greenies the more times that member has had their scales (reputation.gifreputation.gif) clicked and a comment been left.

You can view your points in the usercp, top left.

Be VERY careful whose advice you listen too

Hi again Curlyben!

A good explanation.

...Except for the very OVER simplification as stated in your 2nd quoted paragraph above.

This simplification, amongst other things, was discussed in a Bear Garden Thread a few months ago...

http://www.consumeractiongroup.co.uk/forum/bear-garden/108040-how-do-i.html#post1045042

An example being...A thousand 'Thank U' clicks by Newbies can show up as less than a solitary click by someone more empowered!

Perhaps a small point, I know...But I think it is a valid one to remember!...:)

Hi all,

Just noticed this thread, never really paid much mind to green blob thingies and reputation before, just wondering is there any other criteria to making the leap from Informative to Highly Informative apart from having more than the 250 points? ie post count or length of time being a member etc?

regards,

shane

You will change to highly informative and obtain a light green blob when you obtain more reputation, nothing to do with post count or join date.

Do not quote me, but I think after around the 600 mark you change to highly informative.
