    • Thanks for that information. I seem to think they have similar names and similar addresses and I thought it was Aldi that was offering the great deal that attracted you to that car park. So we are still stuck with Nexus. Please do not call DCBL about a settlement figure.The first reason is that they have your telephone number which is not something you want to give to those vultures as you rightly call them. They will then harass you on the phone and try and send you last minute details the day before the case -which they shouldn't do. And second they are already charging you £60 to £70 more than they should lawfully, to that they will then add the Court costs that they haven't yet paid or incurred and then say that they will give you this great offer of £150 to avoid going to court.Big deal-not. Were it around £50 that would be a better deal but they would not accept that.   
    • Hugo, how are you getting on? the deadlines can creep up on you. It's useful to have a week or two in drafting a defence, so you can understand it for yourself before submitting. Read other like threads for examples and tailor to suit you. Get one drafted and posted (without personal info) and let us take a look
    • OK thx jk2054 I'll go that route, does anybody have any positive reviews of NWNF law firms they've had experience with? I did consider InjuryLawyers4u, but apparently they're more of a broker, & who you end up dealing with can be hit & miss.  Would rather try & get a sharp firm that are on-top of things if possible.   
    • I posted my letter off but over 2 weeks later I've had a visit from one of their reps. I didn't indulge him in any conversation, and I just stated that any such debts are statute-barred and closed the door on him. I was hoping they'd take notice of the letter. Where do I go from here? Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

However, you have to build up reputaion giving power yourself by being a user for a certain number of days and having a certain number of posts.

 

The idea is to give an indication to newcomers as to whose posts they should pay particular attention to.

 

We'll see how the system goes and refine it as we learn more about it.

I'm not a statistician so I can't work it out but I am trying to perceive a line of logic which does favour quite high quality posting. We'll see how it works over the next weeks and adjust as necessary.

 

I want it to be a useful forum tool for newcomers to depend on and not merely a competition for promotion goals.

 

Hopefully it will help to raise the whole quality of the forum information as newcomers will tend to get an idea of the more useful contributions and take notice of them and repeat them in their own posts

It's not that intuitive - you need to count them up, and whilst most people are currently on 'one green dot' it is hard to tell who's green dot is better...!!! Numbers may be a better idea!

In all honesty, I think my favourite feature would be allowing me to turn off mine, as the mods can, because I personally find it distracting...

Sadly, you can only turn it off for usergroups.

 

To turn it off for "Registered Users" would turn it off for everyone.

 

I think it's a good idea.

 

Newcomers to the site would have an indication of peoples experience this way.

If this is correct you can get extra points just for posting regularly, it might be any old drivel. Or extra points just for being here?

 

I might be missing something but surely that is no indicator of the quality of the posts? Feel free to disregard this drivel, of course!

I only mouth my opinion, please look elsewhere for sensible advice! :)

You can give people extra points by clicking on the picture of the scales at the top of a post, or you can take points away the same way. The ammount of points you give depends on how many you've got.

That is exactly the way I interpret BFs description...and as you say, regularity is no indicator of usefulness...still, I think that people will judge differently anyway - if a poster has a query, and your response is easier to grasp than the next, equally valid, response, then the poster will hunt down your answers in the future...

Well, at least give it a chance, it will take time to establish. It's a good idea for newbies to be able to guage who on here is of some use.

 

It's a little pessimistic to be thinking that the system won't work, will be abused etc, when you good folks on here can actually aid the system. It seems to me that if regular and helpful users use the scales system, after a while, you'll all have given each other a nice few points (and gained more to give each other more points on more good threads), and others will give too. Then newbies will see how nice and helfull you lovely people are and you gain more points.

 

I think if anyone's going to abuse the system it will be spotted and the mods will sort it. That's what they're there for, right?

 

I've only £45 to claim back, but I'm damn well making the effort, and any effort to improve this site is good in my book.

 

I'm in. I'll play. I think it will be appreciated by newbies. :)

It seeme to work well on other sites that I post on. I think at the moment people have not got enough points themselves to make any difference when they add to peoples reputation. I think that as people use the system it will change and give a more accurate picture of who is giving good advice. Maybe the mods, who tend to pick up more points, could give out to those who are giving good advice to "seed" the process.

It's not an idea I have come acroos before, but i can see the potential benefits.
