      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well since theyre classing it as a complaint, i would have thought that it will take them at least another 4 weeks totalling 8 weeks to get a final response. what do i do if they say they wont put a default in place of the AP markers??

Take a look at the ICOs "Guidance on Defaults" online.

I dont know where im looking Brig, but what i have found it says creditors will default after 3 months of breaking the Arrangement to Pay, but i never defaulted at all...and i didnt use a dmp, i set up the original Arrangement to Pay through them, directly.

It was possible to challenge AP markers as unfair but this is now very much more difficult, the ICOs take is that AP markers are true reflection of the conduct of the account and should be shown as such on CRA files.

 

 

The major difficulty in your case is that you initiated the AP T think, when I'm in my office tomorrow I'll look up some case details to see if I can find anything to help.

Well They rang me to discuss it and thats when it was set up in 2009. If i knew back then what i knew now...i would have just let it default....cos now the fact i have arrears and an AP brings my score down....and obv the credit accounts wont disappear until 6 years from the last payment/when the account got closed...making it 2017. I want to be trying to get a mortgage in a few years but its gonna be hard!

I got the following letter ::

 

Thankyou for contacting us regarding the information that has been reported to the CRA in relation to your barclaycard account. I am sorry you had reason to complain. I have not tried to call you to discuss your complaint as we do not hold any contact telephone numbers for you.

 

Firstly Id like to apologise for the confusion caused by this matter.

Barclaycard have an obligation to provide accurate information to the cra. Having reviewed our records, I can see that your account was reporting as being on a repayment arrangement from March 2009, prior to being settled in full in March 2011. This information is correct and will not be amended.

 

I note your comments that you may seek advice from the ICO. The ICO says you should be in no worse state than someone who makes no effort to pay when an agreed repayment plan is in place. A credit file with a repayment plan in place is preferable to one with a defaulted debt. The date at which the debt is removed from your credit file depends on when that debt is settled or defaulted.

 

 

So what am I supposed to do now? Can I do anything? Brig or anyone, I would really like your help!!

Having reviewed our records, I can see that your account was reporting as being on a repayment arrangement from March 2009, prior to being settled in full in March 2011. The date at which the debt is removed from your credit file depends on when that debt is settled

If it was settled in March 2011, doesn't their response "confirm" that the account should be removed from your file?:-o

No it will stay on my file until March 2017 :( And I wasn't trying to get it removed!

 

Yes, but surely as it was settled in 2011, there should be no AP markers on it since then?:-o

The CRA file must show the " progress" of an account so AP - Settled is correct. there should not be any markers after the settlement,
