    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I can understand how stressed you may be, wait for The Mould to get back to you.

That way when you do speak to a solicitor/barrister etc you might be able to offer/suggest a defence, their answers should give you an idea of how competent they are in this area of law.

I'd still give it a couple of days for advice, be as patient as you can. Law is very very complex and you need an expert

It might also be worth employing a Barrister rather than a Solicitor, I used one years ago for another matter and it was £500 fixed fee. Some place in Leeds but I can't remember the details.

Can't say as I know much about law but I'd explore all options/costs and take my time.

 

Don't know if this idea is worth exploring or if you have the time.., but how about contacting your local CC and seeing if there are any similar cases going on. I think you can sit in and listen as a member of public, but I could be wrong. Just a chance a good solicitor etc might turn up, or suggest a colleague.

Obviously you want to keep your home and I don't know the details, but why would he have to, no reason why you can't rent somewhere to live.

Local council/Housing Associations would help, and in your circumstances with a child to look after you should get priority.

Just done a quick search for local housing associations in Wales where I live, found one who represent over 70 housing associations and 153,000 properties.

There are bound to be similar organisations where you live, how about giving one a ring for peace of mind.

I know social services can be a funny bunch but if you have an offer of alternative accomodation from an association, it is secure. Not like a private landlord who can sell at any time.

It mentions something called a charging order which can last up to 12 years.

If the trustee agrees to this (their primary duty is to serve the creditor) they retain an interest in the property but you don't have to sell.

 

Might buy you some time to sort things out.

Obviously I'm no expert just looking for things that might help.

 

What has happened is wrong, plain and simple.

Unfortunately I'm not legally trained so can't advise.

What I do know is that what has happened is wrong, plain and simple.

Could we all (thousands of us) complain to our MP or Wendy's one, if they get fed up of complaints they might get involved.

Not sure what problems you are having uploading documents, so we will have to start from scratch. Computers can be very frustrating at times, but you'll get there in the end.

 

First question is what version of windows are you using, I've never used Windows 8 but the principle is the same.

First I scan the documents and save them as a jpg to keep file sizes small.

Next I use MSPaint to remove personal information, save the file and then copy it.

Then I open Wordpad and paste the jpg in using a new page for each file.

This will give you a Word document which can be saved and printed.

To produce a pdf file for uploading I use some free software called CutePDFWriter.

In Wordpad you simply select it as a printer, and then attach the pdf file produced to your post.

 

If you have a pdf file and need to edit it to remove personal information, then if you open it Ctrl-A will highlight the text and you can then copy and paste it into Wordpad.

 

Hope this helps, if not I'll try to answer questions or explain things differently.

Well done for getting to grips with the computer issues, all scans are perfectly readable now.

Even a novice like me can now see the unfair charges and the fact that your bank took your benefits making things worse.

It's games Wendy, she doesn't want a paper trail.

I think trustee's are appointed by the court, maybe they can advise on a complaint.

Your ex could complain too, he is very worried about his share of the equity, trustee ignoring his requests as to how to contact him etc.

Why don't you put all your scans in a Wordpad document in date order, oldest first.

If you can read all your scans in Wordpad print the file to PDF format.

If you can't read a scan then you need to do it again.

Will save an awful lot of problems uploading information.
