I have an issue regarding my son.

 

He was involved in an accident recently whereby he was approaching the double white give way lines as the road he was traveling on,met another road.A driver came hurtling over the give way lines from the other road and straight into my sons car.I presumed that because he had crossed the give way lines,he was automaticly in the wrong.

 

Anyway,today,my son received a call to go into the police station.I went in with him and when he was told he was going to write a statement under caution,I told him to postpone the interview until we had taken advice-The trouble is,neither of us can afford a solicitor,let alone find one who specialises in traffic offences.

 

My question is twofold.Firstly has my son committed an offence? Secondly will it do his case & insurance claim harm if he refuses to give any statement under caution?

 

Any comments will be appreciated.

Thanks-An ambulance was called & I think someone called the poice as well.

 

As soon as the officer mentioned making a statement under caution,I told him that we would have to postpone in order to seek advice-He offered a telephone to speak with a duty solicitor but I declined.

 

Just to clarify my original post,my son was approaching the give way lines and the third party turned blind into his path from the busier road,crossing the give way lines designed for traffic going the other way/the way my son was travelling.

If the other party are provided as being in the blame by the police this will help insurance, I believe they have to charge the other party though.

It's because someone was injured that they need a statement to find out what went wrong.

Give a interview at the police station with advice from the duty solicitor as it will help your case
