      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I hope you don't mind my asking dx a question on your thread as I have almost the same problem and have been climbing up the wall for a week. I'm absolutely exhausted.

You sound absolutely brilliant and I wondered if you could help me too, please, please, please.

 

I have a new laptop with windows 8 and my printer is a Lexmark X2600. I've gone to the link you pasted for Caro but X2600 isn't there, and the info doesn't come up when I've searched that site. I've tried the download from Lexmark and the printer is showing as loaded on the computer but it just won't print. I have pressed every button, removed the programme, reinstalled from the original disk, everything, and it just won't work. I've changed the port from a LPT to a USB and that doesn't work either.

 

I would be so grateful for any help.

uninstall the old driver you installed

 

disconnect the printer till it tells you to power and connect it.

 

is this USB or LPT?

yea thats right

 

you might have to strip everything to do with the printer out first

the old drivers will confuse the port assignment.

 

then start again.

 

also check another usb device installs ok

before you try installing the printer

 

half installed USB devices will prevent new USB devices from being detected properly till the provious USB error is resolved.

plugsomething else that usesa USB port onto the PC

ma e sure another USB device works ok.

 

if there is a part install of anything USB driven it will stop new usb devices from installing

I have a vast number of leads for various things, USB and otherwise, lying around somewhere. Never used the camera with a USB. I will try to dig something out.

 

As you can see I am a total dip when it comes to computers, and I really appreciate your time and help.

its jus a driver issue then.

is it not asking for the location of the driver upon plug in?

 

have you tried using the lexmark software and doing a test page

 

i think there is a comms check there too.

Hi,

 

Yes, I have. It says it's all installed and to 'print test page' and it still won't print it. My daughter has commandeered the computer. I will try and find some other USB cables tomorrow.

No, it doesn't ask for the location of the driver. If it does, what would I put? My postcode? There was something at some point earlier this week when it asked about the networks, but I don't get that. I don't need to be on the internet to use the computer and printer.

No, the old pc was sabotaged when I took it to a bl**dy awful computer shop to replace the dim screen. It went in booting up and came out not working at all and they said the mother board had gone. Unfortunately the lovely lady who used to look after the computer has moved away and the guy who transferred the info from the last pc is miles away. He has returned the hard disk in case I need it again. I haven't used the printer as a printer since June when the last pc broke but I have used it for photocopying so it's working. The problem seems to be that the computer sends the info but it won't travel down the cable to the printer.

 

I'll see if it can print the alignment page.

Go to device manager, right click on the printer's driver, select Properties. What shows as manufacturer? Microsoft or Lexmark? If it says Microsoft you have a generic driver and you have to download the original driver from here:

Thank you, thank you, thank you. You guys are absolutely amazing. I have hit both your stars. I'll also make a small donation to CAG next week.

 

I didn't get a chance to do anything on the computer until now as it's half-term and whenever I might have had spare time to get on the computer my daughter had it on Club Penguin or Moshi Monsters. (She's only allowed an hour a day, btw!)

 

I cleared everything off, and despite the fact that 'properties' said there was already a Lexmark driver, I still did the download (again) and this time it worked. I nearly fell off my chair.

 

You are both absolutely wonderful.

Hi DD. Just seen this.

 

Just to let you know my old printer has been playing up and even the paper feed is a bit hit and miss. I went online to Lexmark the other night and they've confirmed my printer isn't compatible with windows 8 and were surprised when I said I'd had it working with it. Said it was probably only one sheet (er no - tee hee), and then windows 8 updates would have prevented it working. Sounds like a load of codswallop to me.

 

I am sick to death of the thing though so have started looking for a new printer. Was surprised to find I could get a wireless all in one printer for @£45. I'm leaning towards a canon which prints about 600 sheets with an extra large cartridge, which seemed pretty good compared to some.

 

Considering the old printer must be about 6 years old and was a cheap one, I don't mind my OH spending £45 to buy me a new one (seeing as most of the printing is his anyway)! :madgrin:

I've only just seen your post as I came back for some info for someone else. My new computer can be touch sensitive and I have to be very careful when deleting emails as it can easily take out two!

 

I hope you have got your new printer and it is working fine. I've got a Canon photo printer and it is brilliant so if the Lexmark gives up the ghost I'll certainly look at the Canon. I think my Lexmark is about the same age as yours - on special offer for about £35 at the time I think.

 

The thing that is now really driving me nuts about the Lexmark is that PC World is now selling only the two cartridge pack so it's £40+ per time. My daughter is 9 so always wanting to print stuff off and if I don't keep an eye on her she'd use them up very quickly!

Got my new wireless canon printer for £40 including cartridges and a pack of extra large cartridges with colour and black will be £30 (unless I find them cheaper elsewhere). Got it from pc world. It's so easy I wish I'd ditched the Lexmark ages ago!!
