Hi guys,

 

I follwed some advice on here and politely asked the Open University to remove a default on my account. Was quite a nice grovelling letter; however, I was told that as they are responsible lenders, then they will not remove the default and it will drop off after six years. The default in question was registered in 2002.

 

I follwed this up with an email saying

"

Ma'am,

Thanks for your email about OUSBA policy.

 

Could you please provide me with a signed true and certified copy of the

original default notice. If the statutory £1.00 is required then I will send

it on receipt of your email saying so."

 

Today I recieved the following reply

 

"Thank you for your email.

I have ordered you a copy of your default notice today. As this letter is system generated it will not be signed, this is the same as the original default notice which was also a system generated letter."

 

Where do I stand? Is this correct procedure? Should I fight it as they don't have a true and signed copy on file?

 

Any help is appreciated

Sorry to ask again. Do default notices need to be signed?

well i've just come back from court re an account of mine. The balance was never in dispute I had agreed 3 months ago to pay settlement along with removal of default. they have had 3 continuances to date because i won't budge on removal of default. today it was before a judge and although purpose of todays hearing was to set a settlement date he went thru the details meticulously and he was quite clear that if a default notice is not received and company can't prove it, then it's not been served and doesn't comply with CCA. Anyway I'll need to wait a bit longer but i am feeling optomistic about it.
