    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.
    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello Richard I am sorry to read that you are feeling so low.I am not in the same position as you but I have been in the past,are you getting help from anywhere ? I know it is difficult but please do not let fear of DCA's ruin your life you have obviously got enough to deal with,if you can get your number changed to give you a break from the worry.Do read threads on here regarding credit card debt you may feel alone but trust me you are not,the breakdown of a marriage is hard enough to cope with on its own it is akin to bereavement so you need time to deal with this.One very important piece of advice never be afraid to ask for help.

Stay in touch Richard,the phone thing can be overcome eventually I went a couple of months this year not answering mine when it rung,one day I got annoyed answered it and told them to go away and only make contact via mail.I got plenty of practice as you can imagine,it takes time but you will get there.

 

The only way is up.

Promise me one thing, though. Do something nice for yourself every day! Just spend a few minutes on yourself, doing something you enjoy. It doesn't have to cost anything - read a page or so of a good book, have a long, hot bath with lots of bubbles (OK, that's my favourite; probably not a man-thing!), get out in the fresh air - whatever makes you happy. You deserve it.

Aha, I'm eclectic in taste eg: Wagner I love,most of TRex ,some operatic arias (they make me cry in a good way) Song to the Moon from Rusalke always reduces me to tears,Flamenco, Brass Band music including Mexican,Pipe Bands, all ballet music Native American music and not forgetting the rock anthems Blaze of Glory,Up Around the Bend,the opening chords do something to me I'm not sure what.....the list is long.I'm not sure what this says about me :lol:

I got a DCA letter today,,,and do you know what I did? I didn't break down in floods of tears,,nor did I have a meltdown,,,I opened it,,glanced at the drivel,then tore it into shreds and filed it in the 'to be burned' box in the shed :) They will soon get bored of sending me bonfire fodder :)

Well girls,

what are we going to do with our boy Richard ? he is obviously selling himself way short here.Educated,sociable, well read,open,kind,well we all see it the trick is to get Richard to see who he really is.

Memo to Richard -you are not your illness it really is only a small part of you it just looks insurmountable at the moment because of what you have been through,the description of the real Richard is in the posts above.It will get better just have more faith in yourself and the real Richard will eventually surface.

Hi everyone,

sorry to hear about your dad Lilli I lost mine the same way many years ago it's an awful thing and I agree with what you say regarding the ethics in these circumstances.Girly, I'd love a bungalow but you can keep the bramble I get tons of it because I feed the birds they deposit all sorts of seeds mostly of things I don't want and bramble is top of the list. Janie you have sunshine you lucky person it's cold and miserable here,OH did our lawn last week it's grown again already :ohwell: my hedge is jasmine and honeysuckle so it won't get cut until next spring yipee.Richard when you feel able to get out in the garden you could let us know what's growing out there anyone who gardens is nearly always interested in what is in other peoples,well I'd better go and do something useful in the house or I'll feel very guilty later.I won't really that was a porkie-sorry.

I'm fine now thanks Lilli -my tum hates egg custards,which is a pity because I love them.I know what you mean about bugs all of them I attract them like a magnet these days.I have been spraying the place with a tea tree oil solution-it smells iffy but it makes me feel better.I'm really praying for the dog to be found, Richard don't forget the garden I got some little cyclamens today they look so happy :cheer2:

Glad you're feeling chirpier today Lilli and enjoying the sunshine,it's clouded over here now but at least the laundry is dry.I'm getting ready to tackle a mound of statements :sad: I hope the rest of you are doing something more fun, I'm definitely doing some gardening tomorrow even if there is a force 9 gale outside.Richard you've been voted team leader ! We're in the same boat I'm not hung up on money but I live with someone who thinks the word budget mean a cross between a budgie and a parrot so every few years I'm on mop up duties.You will have to lean on British Gas I had the same thing with Scottishpower a couple of years ago I had to really fight to get my money back nearly £400 and get them to lower the monthly rate,it's out and out greed with them.I hope the kids have a great time and enjoy the peace.

Telly time now for me I'm whacked.

maybe the old man trusted you ? it's a back handed compliment maybe.Aren't you the lucky one to have a lawyer in the family and it's no bad thing to be left financially secure either it's always sad to lose someone but nice to know they cared enough to leave you something for when they have gone.Great news about the BG refund and the new meter I could do with one as well the present one is up near the ceiling-and I'm a shortie.Enjoy your dinner see you later.

Oh well it's the thought that counts :eyebrows: btw 65 comes round awful quick.A rich man in a big family well I expect he gets talked about then if he's the only one some of my family were the first on the doorstep if they got wind of a few bob,I expect like me shopping is a bit of a stretch I hate it when they stack things right up on the top shelf.....it's discrimination.I'm soooo pleased I'm not the only short person with an ability to verbalize.Loudly.

Oh I know this one,the b....rs sleep all day then middle of the night start attacking the wallpaper if you don't get up and let them out,early morning telly isn't enough to stop me from falling back asleep then I get up feeling awful. OH somehow never seems to hear them :lol: Early night for me I did a bit today.

I hope the mogs are as tired as me you'll get some peace.

The cats sound lovely what a shame about the accident,I think toms are more affectionate I have only got one left now and two queens who mostly don't bother but the tom needs quite a lot of attention he went like that after his brother died in mysterious circumstances last year.Men and hoovers what is it,we had a fall of soot last year and my OH cleaned it up but forgot to put the filter in the cleaner,he was still out there hoovering away when I came in and shreaked the place down all I could see was a big black cloud coming out of the kitchen which I had just finished painting,he was in the middle of it all as black as the hobs.What's wrong he says- he didn't get any tea that night.

Lilliland doesn't sound that bad :lol: I hope there's something on telly tonight I'll nod off and himself can tell me all about it tomorrow.
