      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If the incoming funds are clearly identifiable as being benefit payments then they cannot be taken no matter who's account they are paid into. As remember the benefits can be identified as coming from the DWP so are clearly benefits.

Notwithstanding that their charges are unlawful therefore recoverable any other monies that are not benefits which go into an account can be taken by the bank unless you send a 1st appropriations letter one of which you will find here

Great........Just a point when they reject your DD there is no human intervention it's all automatic which makes it even more of a scandal.

 

Also are you sure about the Halifax £5 buffer. I think I read it had been withdrawn.............Thinking aloud it might have been Lloyds. Either way be careful 1p over & you'll get hammered for unlawful penalty charges & you'll have to go through it all again

Spend a little time & read the FAQ's to get an idea on how to proceed. Open another bank account as they will in a state of peek close your present one As you are doing that send a SAR with a £10 postal order requesting all the data on you they hold (letter in the templates library)

 

Then when you receive that you can calculate what they owe you. The same Social Security Act referred to in this thread that applies in England applies in Scotland

As a matter of urgency (& I never usually recommend it) phone the bank, ask for the manager & politely tell them they have taken your benefits illegally (as per the act) & you would like them back NOW! If they get stroppy tell them you WILL report them to DWP then do it anyway 1st thing monday.

 

Don't often say this either but the DWP can be very good in such circumstances & will often phone the bank on your behalf & advise them of the error of their ways.

Nattie agree

 

The bank have to refund the benefits & babyblue can argue (as we all do)about the unlawful charges later. In the meantime she can stop them taking anymore if she uses the template letter at the head of this thread

1st copy the letter by Martin3030 & myself at the head of this thread & send it to your bank now as it needs to arrive preferably before any further benefits are paid in. To be ensure your money you need to send the same letter specifying which benefit to which your referring just prior to each payment.

 

In the same letter mention that you now know they have breached the Social Security Act 2002 & demand they return all penalty payments they have taken from your benefits.......should be fun

Phone them back using this service http://www.rectel.co.uk/destination.cgi & try & speak again to the nobody who upset you..........Their ID & when they phoned will be on file

Ive just seen this thread and its brilliant.

Im going to be sending a letter of appropriation to Abbey seening as they want to take most of my child benefit leaving me with nothing for my 1 yr old.

 

Do I send the letter to registered head office or local branch??

for the template letter go to the 1st post by Martin3030. THis tells the bank that if they take your benefits they are acting illegaly as they are in breach of the Social Security Act

 

The letter can be sent at anytime & you can demand they refund of all such previous penalty charges taken from your account

Phone back & ask that the person you spoke to write to you & explain that they are allowed to take you benefits as claimed. Then let us know what was said.

 

As you are in dispute with the bank you must be pepared for them to close your account
