    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey everyone i'm new here and i'm in need of some advice regarding council tax. Between August 2010 and June 2011 I stayed in a flat with two friends from university. During the year we got no notification from the council regarding council tax so we completely forgot about it until the landlord notified me at the end of the year. We never signed any documents to rent the flat when we moved in or even payed a deposit (in hindsight it was a dodgy private let). On the final day in the flat when I was the only one left and everyone had went home the landlord made me sign a lease of some sort then we shook hands and I left soon thereafter.

 

Upon trying to sort out the council tax when I got home my 'friend' informed me that he had dropped out of uni months before without telling me or the other flatmate. So I sent in a discount form instead which reduced the amount from £1100 to around £850 in the belief that my friend would be liable for the debt as me and my flatmate were students. However because I was the only one who signed this lease apparently Glasgow City Council say that i'm the one liable for the debt, even though i'm a full time student and my friend is not. I sent an email explaining my situation to the council and they said they would contact the landlord and get the liability switched over to my friend. However, recently I've been getting letters, phone calls and texts from BPO collections about the debt so obviously it was never sorted out and it's stressing me out at the worst possible time. I'm about to start my final year in university soon and I want this problem to go away. I fear if I leave it alone like I have already been doing that it will escalate and my credit could be affected. Is there anything I can do?

There was no written tenancy agreement when I moved in but I signed a tenancy agreement on the last day in the flat detailing the length of time I had stayed in the flat, between August 2010 and June 2011. I had a search on landlordregistrationscotland but couldn't find anything there. Although he did say he was planning on selling the flat during a conversation we had before I left so i'm not sure if he did or not.

I am afraid the council will not be concerned with who lived at the flat , only who they can chase for payment.

I think i'm going to email the council one more time, explain my situation and hope for the best. I have a few other questions though regarding what happens if it turns out I WILL have to pay.

 

Will the collection agency increase the amount of debt that I have to pay so that they can make a profit on collecting the debt? If so can I still pay the council directly via a monthly direct debit and cut out the middle man?

 

Also will they require bank statements off me in order to see how much money I have? I've currently got enough to pay it all off as I've been saving all summer but that will be used for rent and living expenses over the course of the year and cant do without it.

Collection agencies do not collect ct debts it is sheriff officers. A 10% surcharge is added tO the ct debt and his covers the so's fees so will not increase . If you can get n arrangement in place then great if not the so will apply for a charge for payment which can allow them to apply a bank or wages arrest net

I have sent the council an email regarding my situation and I will see what they say. On the glasgow.gov.uk website they say "The discount award is based on the full household circumstances and the full-time student will not be held liable for Council Tax" so I don't see why they're doing this to me.

So long as you can prove that you were a fullt-ime student at the time you should not be held liable for the council tax. If you continue to be chased you should consider a formal complaint, this could be further escalated via the Scottish Public Services Ombudsman:
