Hi All

 

Wonderful site, so much wealth of information.

 

Short background

 

I had a eviction notice for 5th July 2012, has a hearing on 3rd July 2012, Rooftop did not show up in court. Judge postponed and requested to my advocate that I should write a letter of proposal and solictors letter for the potential buyerand submit to court by tomorrow. I am in the process of preparing a letter but am finding it difficult.

 

Please can anyone help me prepare a letter to the court as I am having problems with the wording. We do want to remain in our property but if the judge says no we do also have a buyer we just don't want to be reposeeseed.

When you say advocate - do you mean you had a solicitor in court with you?

Thank you, yes he was a solictor. I used a co called Abacus who found him I was charged £395.00 for 4 mins in court... No money so I will defend myself

Did the solicitor complete the N244 for the hearing? if so what did they put in Q10 of the form? i.e. what proposal did you offer

The following was for Q10 = 'I WILL BE MAKING AN OFFER TO PAY THE CONTRACTUAL MORTGAGE PAYMENTS AND AN AMOUNT TOWARDS THE ARREARS. i WILL BE PROVIDING AN INCOME & EXPENDITURE AND PROOF OF INCOME TO PROVE THIS OFFER IS AFFORDABLE'.

Is that all he wrote for £395 ???

 

Was there no mention of the Norgan case law?, or an explanation of how you came to be in arrears?

 

did you supply an income and expenditure sheet?
