      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

brought a 3d tv last week - have to admit i was a little picky as i wanted 2d-3d and mkv support

 

after going through the specs online with the sales lady (pcw mansfield) we settled on a toshiba 42wl863b

the only issue was the last one left was the disply model which we agreed to take

 

didnt get any sort of manager discount on the disply as i used my staff discount

 

got it home and couldnt get the 2d - 3d conversion working

had to go to work so left it untill this weekend and tried updating the firmware see if that would help

 

wouldnt take the firmware so ive had a good look at the back of the telly and its a 42VL863b not the 42WL863b that we thought

we were getting the main differnce being no 2d-3d conversion

 

so paul what do i do im not really happy about returning the telly as theres nothing else in the price range apart from the logics (very poor reviews), its all connected and its cost around £30 in assorted cabling even off ebay

 

and can you check that the WEH i took out covers a 42VL as if i send it in and its says a 42WL im likely to get it back unrepaired

well id kinda realised that to be fair

 

im not going to return it i was only going to use the 2d - 3d for games and seen as the spec sheet for the next xbox shows blueray and 3d support ill just upgrade to that next year

 

the leads were a mix, theres 3 1.4 hdmi 2x 2m, 1x5m, then there was a component cable for the ps2 as the old coax one didnt fit, then 2x ethernet leads, 1 for the smart tv, one for the smart blue ray, there was also a little hub as id run out of lan ports, then a 6 socket extension lead

 

budget for the tv + blueray player (bd-e5500/xu) + leads + 320gb hdd for 3d films was a total of about £600

no it was sold as a WL

 

as it was the display model its got the model sticker on the reverse of the remote that says WL

they had to print the manual off they printed the WL manual

 

really all i need is the coverplan details updating if there wrong now, had a think about it and im happy without the 2d-3d

 

didnt know about the update allowing sbs from the usb weve been running them through the blueray lately, it played mkv before but wouldnt let you go to 3d mode from it, it had the update around 3 days ago

 

still only got about 20gigs left on the 3d film drive so will try a few direct through tv, weve had the occasional audio issue from the dvd player so it might let us know if its the codecs on that or the files messed up

just tried it does play 3d by usb but its very int mit

 

some it doenst like the audio codec on, some it goes into top - bottom mode although its a sBs

on one of the SBS videos it went into top bottom mode

 

little annoying as it ussually asks you which mode to use but doesnt seem to by usb

 

ill stick to the usb port on the blueray player
