    • Thanks for this! I'm still not clear if I'm facing more than 6 points on my license though. Can you explain any further please? When I accept the 2nd speeding ticket, will they just charge me £100 and 3 points, or will they be more severe concenquences since that offense took place the following day of the 1st offense? Similarly, when I accept the 3rd offense, will they look at my record or just charge me with the £100 fine and 3 points?
    • Yes of course. That's why it says cc:: BIg Motoring World at the bottom. Don't imagine that this solves the issue. It doesn't. He not have to force the finance company and big motoring world to accept the rejection to give your money back. I suggest that you get the letter off tomorrow. And let us know what you hear but on Friday you should then send a threat to the finance company.   Have a look what I have said here about your options and read the whole thread as well.  
    • Been perusing the actual figures on the polls above wondering where the '16% claimed for deform comes from? I understand that there are 'weighted' end results based on secret calculations ...   Probably going to repeat this later, but remember that the ukip/brexit/reform/deform party has ALWAYS had poll speculation FAR better than their actual  performance at elections - by large margins. SO: The labor and Tory votes come largely from simply the people who say they will vote for them - sorted Lab 43% Tory 20%, with maybe another small 1-2% coming from the weightings of the 'not sures' Greens largely get what is declared from 'other' , although with another declared green bit from the 'pressed' question   So as the share of the voting displayed in 'other' granted to reform/deform is around 11%, where does the '16% too often being reported come from? Seems that reform has been granted as beneficiary of effectively ALL the don't knows and wont says, who when pressed didn't actually declare for someone else ... effectively adding 40%+ to their reported polling % - rather strange given their consistent under-performance compared to polling - or perhaps that is the cause of the higher rating eh?   Now I admit the possibility (probability?) of wingers being ashamed of declaring their support for the yuckey lemon end of the spectrum ... but surely  that should affect the 'Torys as well? Maybe the statisticians have simply weighted in that deform wingers are simply more likely to lie?   But - without 'weightings' and assumptions that faragits will get everything that isnt declared as a definite and unequivocal 'not that Piers Morgan' - reform is on around 11% it seems.   Add to that the history of polling a lot less than the hype - and the simple fact that faragit wingers seem to be spread across the country (presumably skulking in their moms spare room despite being 45+) and greens and lib dems seem to be community minded - I think two seats will be an epic result for farage. Hardly the opposition - far more raving wingnut party.   and importantly - Has farage got a home in clacton yet?

    • Please go back and read my message posted at 10:27 this morning @jk2054. I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Last week I was in M&S.

I needed to pick up a pack of bacon and ham for my daughter.

 

As a life-long vegetarian, I don't like handling meat, even wrapped, so I took one of the plastic bags for loose fruit and veg and popped it in there.

 

There was a sale rack of clothes just next to the food hall and I had a quick look then stupidly walked out forgetting I had the meat in the bag.

 

Next thing I knew a man in a hoody and jogging trousers ran behind me and asked me to step back inside,

he didn't say who he was, he wasn't in any kind of uniform.

 

He told me to go upstairs, and took me to a little room where there was a girl writing notes.

I was informed that they were calling the Police and it was up to them if I was given a FPN or "locked up".

 

They took the meat off me and he asked the girl to put it back in the fridges.

He took my name and address and by this time I was so scared I needed to go to the toilet badly but was not allowed to go even though I said I would leave all my belongings with him.

 

I was told it would be up to the Police if I could go to the toilet or not.

I was asked if I had drugs or anything sharp that could harm them (I am 60 and disabled).

 

When the Police came I was asked my name and address and one of the Police asked this man

"Do you really want to do this for £2.49?",

 

I was then issued with a FPN, I haven't paid yet, I haven't the money, we live on a State Pension.

I was also given a letter about banning from their stores and Drydens Civil Recovery.

When the Police were about to leave I asked again if I could go to the toilet and they said yes.

 

I have medical problems, bladder problems, severe spondylosis and I saw my GP in April because I have been having spells of almost fainting where everything seems to go far away.

Have just lost my elderly Mother too.

 

Please can anyone advise me what I should do.

 

I haven't even told my husband as he is also disabled and I don't want to worry him.

I haven't been out since this happened,

 

I feel so scared.

Its not clear what advice you want ?

 

I was under the impression that a fixed penalty notice had to paid at the time, Im unsure as to what would happen if you dont pay it.

 

A FPN is you saying 'you admit the crime but it wont go to court, instead pay the FPN of £80, or whatever it is', you would also of been given the option to not accept it and then possibly it would proceed to court where I assume you would say you were not guilty, although I BELIEVE IT IS UNLIKELY IT WOULD ACTUALLY PROCEED TO COURT.

 

You may also get a request for further damages from Drydens, I dont believe that are realted to our fave comapny RLP, but not doubt would operate in s similar manner.

Hi Andy, thanks for answering. I didn't even get the opportunity to explain what had happened. The Policeman just got out a pad and said he was issuing me with a FPN, I didn't get asked if I wanted to accept it or not.

However if the recipient neither pays the penalty nor opts for a court hearing in the time specified, the penalty may be increased by 50% and registered against the recipient as a fine"

 

I would of thought you should of been given a chance to say what happened, there has been another similar thread where it was suggested the poster try to obtain cctv footage from the store interview room.

 

You may simply decide to pay the FPN, your choices would appear to be to pay it or dispute it.

Write a Formal Letter of Complaint mark it as such. Explain whats happened, the treatment you received/your circumstances and what you want them to do. Explain that it was a misunderstanding and you tried to explain only

for your explanation to to be ignored by the security guards.

Thanks Andy, if I felt stronger I would definitely dispute it, it was a genuine mistake and I felt totally humiliated. Looking back I would have handled it differently, easy to say with hindsght.

 

There are many similar threads on here where people, often vulnerable, young, old have been 'held' for long periods and 'admit'/sign things despite their better judgment.

 

Clearly any request from Drydens/M&S for damages as a civil claim can be ignored as they have no legal basis, but its unclear as to what action could be taken about the FPN.

I would send a copy to the Police Station that sent the PC's and a copy to Marc Bolland, Chief Executive.

You need to ask Marc Bolland, why would you steal meat for '£2.49', when firstly your a 'vegetarian' and secondly the low 'value', that really needs pointing out. Mr Bolland will pass down a 'nice' memo to your local MS store.

Also ask MS to deal with the FPN with regards to the monies and any implications to you. Make it clear that you will take further action.

Have you received responses from the letters you've sent off?

 

I've just received a letter from Drydens asking for £85.55 "as our client suffered a loss that they are entitled to recover from you." Don't know whether I should pay it to put a stop to it.

O.K. lets wait, give (M&S) them a few more days. Don't panic over their (Drydens) letter, wait until the next, lets see what they send. I really want to see what M & S say.

 

Hi rebel, I had a letter from the Police just confirming that they had received my letter. Nothing at all from Marks and Spencer.

However, the security guard has lied about not letting me go to the toilet. He says that I was asked if I could wait 15 mins. 'til the Police arrived which was untrue as he said they didn't know how long they would be, sometimes two or three hours.
