      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone very glad i have found this site really need help

 

I have payday loans with wonga, payday loans, quickquid and lending stream all of which have gone into arrears (the last few weeks) due to me losing my job.

 

I have tried to contact all of the companies by email and phone and basically they are not listening (lending stream for example dont even reply or contact which i find strange) payday loans ring me 20 times a day but do not listen and will not agree to any kind of payment plan.

 

I have no savings but am obviously looking for a job , does anybody have a good template letter i could use to send to these companies so i might get somewere?

:?::wink::violin:hello and welcome please try not to stress ul get the help u need on here soon enough just repeat ur email sending requesting a payment plan and lending stream are notorious for ignoring customers but sit tight the right person will be along soon probably at work like me now lol so check back later and chin up ul be ok

Have you tried National Debtline or Citizens Advice ? really please use something like this to the full, make sure you get all the help you can possibly muster

 

Your in a vulnerable group right now being out of work, remember the payday loans are not priority you can't afford much if anything, there are other needs make sure you have food and a roof over you first also see if your council runs a food parcel service - where you may also be able to get help and advise with debts too (all what I've picked up along the way)

 

There is a libary on here for letters or get National Debtline to help with templates,

but it always seems best written in your own way that you can't afford to pay to the payday lenders and just explain your out of work

Agreed asmilecostsnothing. National Debtline are amazing at helping people. They have lots of experienced debt professionals, plus they can advise on lesser known goverment or private schemes to help you make ends meet, or even put you into a DMP and try and sort your debts out for you, free of charge. They can also put you in touch with legal advisers if you are being threatened with court action.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

i actually already have a dmp with my credit card debtors (that i set up myself by using the national debtline templates)

 

have re emailed my paydayloan debtors and will report back on any replies on here if thats ok?

 

really appreciate advice given really do

hi ur doin well keep at those emails and only pay what u can afford dont let them force u into paying more and remember u cant go to prison for a payday loan debt and if they wont accept ur offers and it goes to dca then u will be able to negotiate but u must remain firm at all times xxx:whoo:

You'll need to amend your self-managed DMP to include these Payday loan firms also.

When you contact the Payday lenders be sure to instruct them that you remove their 'continuous payment authority' as this should prevent them from having the right to take money directly from a debit card. You may find greater peace of mind by switching your current account to someone new, this is known as having a 'safe' account.

i am in the process of amending my dmp anyway due to my recent job loss :(

Lending stream have taken two payments totalling about £160 over the weekend from my account , this was a large proportion of the last money i was owed from my previous employer. However as i stated above they do not respond to emails.

 

Any help with this appreciated as i really could do with that £160.

Do a 'chargeback' Ring your bank this afternoon/evening and demand it or call into your bank and don't be moved till they see you (you have to be that strong) Remind them of your financial hardship (no offence meant) you'll need this money to survive I would recommend now trying another way of communication with LS (formal letter of complaint - write complaint) and please get a safe account sorted asap - unconnected bank or building society it may be the only way to stop this

just spoke to bank on phone and they stated that because the transaction is "pending" they can not cancel it yet and i have to keep checking until it hits my statement then ring back...

 

thanks again and i do have another account set up now with the halifax which is just a basic account

Actually thats a good letter. Theyre letting you decide the repayment rate and they guarantee to accept it as long as you dont miss any payments.

Good job. If they try and say no for whatever reason, state that you have in effect, a written legal document from them which states that they will accept what you can come up with each month. Since the max is £1, they cannot decline it :D.

They've pretty much shot themselves in the foot and you need to take advantage over it.

 

Just remember though, Do NOT default on it. They are being pretty generous right now.
