    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

by prospective lenders, this is noted a lot by HP lenders, and Car Rental

companies check this to.

I've looked at my credit reports with all three CRA's and the only one which looks accurate was Experian. The others all had things missing, particularly Call Credit and less so with Equifax, but still gaps. Experian was complete and i had to call them to check a couple of things and they were really helpful, Call Credit and Equifax were both useless, and they got quite abusive when i explained they had things missing compared to Experian.

 

The only problem with Experian is their on-line service is more expensive (Credit Expert), but seeing as the other two are incomplete i guess its still the cheapest option to see all my data.

checkmyfile is worth the £20 per quarter [as all 3 cost +£7 each pcm]

 

and it shows all the dif cra's in one place.

 

they respond to queries, and actually work for you in problems alerted to the other two

 

they seem to get results on disputes too

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Checkmyfile is just Call Credit and Equifax. It DOESN'T contain Experian's data so there will still be gaps.

 

They're very clever about referring to Experian on their page because everyone know they have all the data, but if you look at the small print, they only have the lesser two CRA.

The point being missed is that not all companies/lenders report

to all the agencies, nor are they required to so variations can

be expected.

The CCCS insist on Equifax, so who doyou go with ? I had a debt on noddle and it said it was satisfied, no longer a debt, go figure

I always say check all 3 main agencies, this just

proves another point that keeps cropping up the

CRAs DON NOT SHARE DATA"!"!

Checking equifax report, I owed £ 112 to a bank. On credit report it says the debt is settled, which it isn' t, unless I have a mysterious benefactor . Do I contact bank for comformation, what is the best way to proceed. I dont want them chasing me in the future

I spent all of yesterday trying to see where an old debt of mine had went to from RBS, dating back to 2005. I still have to get confirmation but it looks like it has been written off as it was given back to RBS from Rockwell in 2008. After this, there is no record where the account is. Hopefully you are in a similar position.

Youe debt may be SB' d, but I am reluctant to approach the creditor direct, imagine saying , hello my name is Mr xxxxx and I owe you money. I checked two out of three cr' s and it says satisfied. So do not know what is the next step

I am a great believer in letting sleeping debts lie - you could accidentally restart the statute barred clock here - it sounds like it should drop off your report soon.

 

As long as it is settled you should not worry - if it is settled you can provide proof that the report says that so shut up and leave you alone.

 

Don't go round making trouble for yourself in this aspect.

 

The CRAs are no longer fit for purpose in my opinion as they are farming out OUR data, we should NOT have to pay one penny for them to provide us with this information, most of the time it is irrelevant anyway.

 

To put it into context, if every time a bank failed one of its customers it had a restriction on it for six years where it could not borrow above a certain amount, nor set up another legal entity company this recording process would go against it - however it does not.

 

There is neither transparency nor fairness in the CRA systems anymore.

I am not sure if its statue barred because the last payment as far as know was made through euro debt in 2008. I thought it was a bit too good to be through but credit management have no recollection of the account and I have been advised it has more than likely been written off, since it was passed back by rockwell.

If any payment has been made and it matters

not who paid it or how it was paid the bebt

is not statute barred.
