Hello all,

Just thought I'd start a thread with my details in to show that I'm starting the process today! I have printed all my online statements for 6 years (my boss thinks I'm wasting trees - but he is interested in the outcome!!).

Gonna be a couple of days wading through to find the charges, but it will be worth it in the end.

Fingers crossed it will all be sorted by Christmas - won't that be nice!!

Right, well I finally worked out that HSBC have taken £1073 that is mine. Gonna send off my initial letter "request for repayment" tomorrow.

 

Only thing is should I send it recorded???

Nothing newsworthy yet (or any contact at all actually) - LBA sent :D

Right, got a letter back from HSBC today - they've offered me £920 in full and final settlement......

 

Now I have a dilemna now... I really want to push for the full amount (even though it's only another £150) but £900 would be really useful right before Christmas!!

 

A couple of things which may decide it:

 

1) if I say yes to the £920, will it stop me putting another claim in the future? This claim was dated Oct 2000 - Oct 2006. Will I be able to claim for Oct 2006 onwards in the future?

 

2) if I accept the offer as a partial payment, do they have to pay up now, and then it carries on for the balance, or will they only pay out once I accept a Final Settlement?

 

Any advice greatly appreciated - thanks guys.

1. If you accept don't sign their letter, compose your own and include:

 

I accept this offer without predjudice and I reserve the right to make any further claims should you apply future charges that may be considered unlawful under common law or in violation of the Unfair Terms in Consumer Contracts Regulations 1999 or Unfair Contract Terms Act 1977.

 

 

2. Only on final settlement.

Thanks Michael - I know I have a moral obligation to push this through to the end, but £920 right before Christmas is soooooooo tempting :D
