      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Today i have started Champix, i have been smoking for 44 years, i have stoped for a few days before with no help, but i feel i need some form of help, i have started by trying to reduce the number of sigs per day. I use to smoke 30 a day. So i am happy today so far only seven cigs so far hope to keep it to ten for the day. I write down the time i have each cig and what i was doing so i can cut down on the number of cigs i do smoke each day. My main aim is to stop the cigs after the first week, will let you know how things are going on. :-D

Hi,

I used Champix. I started in October 2011 and on the 26th, I smoked my last two cigarettes. I am now off Champix and I haven't had a ciggy since. I'm not going to say it will be easy. I found myself stalking smokers just so I could get a whiff of smoke :|

 

Champix isn't for everyone and you need to see the smoking nurse to make sure you are not having adverse reactions.

 

BTW, I was a smoker for 38 years

Thats how i gave up. i set myself 10 days from the first champix tablet to slowly cut down then last ciggy on day 10. Its been nearly 4 months now and i feel a lot better for it.

I'd been smoking for 29 years. I only took champix for 4 weeks then stopped taking as i kept forgetting but they helped for the initial stopping process.

Good luck, keep going and remember, just take 1 day at a time...

Afraid I had the full 12 week course. I felt I needed the extra support of drugs.

Even now, I still have the cravings, especially after food or at bedtime but the majority of the time, I don't think about smoking.

yesterday i only had smoked 10 cigs considering i used to smoke 30 a day. This morning all is still going ok, up at 6am and have not had a cig yet for me that is good as i use to have a cig first thing in the morning with my cup of tea. My goal today is to smoke less then i did yesterday, will let you know how i get on this evening. Thanks to thoes who sent me some messages. Hope to write on this forum each day its another way of helping me give up the cigs.:-):-)

I recommend seeing a doctor rather than nurse. If you have ever taken any anti-depressatnts - Champix is not for you. Low levels of iron? Anaemia? Dont use it or contact a doctor. I witnessed toughest and the most fit people(even though they were smokers) collapse, go dopey, angry, sudden kidney problems, headaches, you name it - they experienced it. Vanericiline was used on soldiers returning from war and worked as an anti depressant. Side effects of drug were discovered - soldiers stopped smoking. @Silverfox - what you are describing seems to be not cravings but your habits. you are used to smoking after food. Champix will develop a "whatever" attitude in you to the cigarette so that you stop enjoying the taste and the little buzz a cigarette gives you but you miss the routine.

thanks for your reply. After 14 days now on the tablets i have had no problems with it. In fact i have been off the cigs for a week now and do not feel the need to buy or smoke any. I think everybody who wishes to use these tablets in order to quit cigs should look into them and get as much advice as they can, most people that i know that has used them have found them to be the sort of help they needed to stop smoking, you must want to stop smoking in yourself in order to stop, these tablets will not do it by themselves. but so far for me i am on track to stop this bad habit that i started when i was 14 years old. but again thank you for your concern, and by the way some nurses are better then doctors well thats what i think as i am married to one.:-D:-D:-D:-D

just a little up date as i am just about two months off the cigs, still on champix but gone back to just 1 a day and still do not crave a cig. so i feel much better now and its nice to be able to go into a shop and stand beside a person paying out for cigs, and be able to just walk out as if you never smoked a cig before.

and the money saved stands out with more in your pocket, fantastic,,,,,,,,,,
