I have received all my statements with no problems from the Abbey, and within the 40 days. I have calculated that the charges are £4,690. Do I claim for the £4,690 in the prelim letter and not mention the interest, and then claim the interest at a later stage. Or should I enter two separate claims for the last 6 years... It was quite exciting to see the amount it came to in the end... Just waiting for statements from the Halifax now. Can't wait !!!

There are 2 instances of interest you can claim:

 

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

 

However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

 

Vampiress has a spreadsheet, (the advanced one), in the bank templates library, which attempts to calculate this

 

It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

 

This is the interest referred to in the preliminary and LBA letters.

 

2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim

 

 

If it ever goes to court, you've got a bit of a schlep to get there!!

Thanks for that. I will send off my Prelim letter requesting the charges and see what happens next, whilst going after the rest of the banks etc. It will keep me busy for a while i think...

I have now received a reply from Abbey telling me to go through the ombudsman and that they will not pay back any charges. It makes me so mad, as I ended up changing mortgage company, more charges with Halifax whilst trying to get out of debt, and Shabby pushing me further down as far as I can see. I think I have to send my LBA, or can I go straight to Money Claim now seeing as they have replied. Shabby say that I entered a contract and that the charges are just because of the way I conducted my account. If they hadn't charged me excessively I wouldn't have to do this. I ended up selling my house in the end... Grrrrrrr..... Any thoughts anyone? Did aAnyone else get into the same mess as me.... Looking forward to watching Watchdog tonight !!!
