    • Reprimand issued to Birmingham Children’s Trust Community Interest company in respect of Article 5(1)(f) and 32(1)(b) and 2. A child protection plan containing inappropriate personal data, in the form of criminal allegations against a child, was sent to the family the plan was produced for. Although the care plan itself was authorised for the family to view, the criminal allegations were not relevant to the plan, or authorised for the family’s view. The investigation highlighted that appropriate technical and organisational measures were not in place at the time of the breach.View the full article
    • Does anyone know what legal term I need to use to say they have to send a deferral form?
    • Just had another look through but I can't locate anything like that. They did, in a previous letter, reference my call in June 2021 but I cannot see this referenced in what they have sent. Worth requesting this specifically do you think?
    • I see the poops (how appropriate) after 14 years of massively deteriorated monitoring and quality, are designating sewage polluted rivers as 'bathing water sites', presumably hoping that the high magic of designating them 'bathing water sites' and trusting the water companies who have pored poo in thewater for profit - will at least monitor it better if not stop polluting after the magic ritual. Undoubtedly this feeble effort has nothing to do with a GE pending after 14 years of abuse eh?   Four wild swimming spots along the River Dart in Devon that suffer from high levels of sewage pollution have been designated by the Government as “bathing water sites“.   River Dart given 'bathing' status after swimmers desert it over sewage concerns INEWS.CO.UK Bathing water sites welcome their new designation - but warn much work is needed to ensure pollution levels are reduced   A poop Overlord was alleged to have been heard mutter - well if we win the election, we dont care what any monitors say and we'll just bury the results, and if labour win its their problem.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, just fired the first shots over the bow with Barclaycard re PPI paid as finally got chance to look at this card. Asked them to provide any evidence of me actually signing up for PPI or refund.

Got the reply of

your application for ppi was submitted online. At the point of applying for the ppi, the process required you to select the specific type of cover you required.

In addition we conducted a review of the documentation you viewed during the sale. we satisified...

you may consider this letter to be our final response..

this just really doesnt sound right

will add full letter tomorrow.

any advice?

Somewhere on CAG Online PPI is mentioned and some tips on what you can do, I did come across this Url below

http://www.lawontheweb.co.uk/Missold_PPI_Claims/What_is_PPI_Misselling

An unfortunate corollary of this, however, is that it is difficult to prove mis-selling when the PPI was purchased online, as in this case a full set of terms and conditions is usually available to the seller, so it is their responsibility to absorb them.

Nevertheless I assume someone with answer your concerns pretty much soon. If I come across the thread about applying online for a loan and ticking (pre-ticked possible) the PPI box, I will add it here.

.Hi

Don't necessarily believe what the bank says.

Even of it was done on-line it doesn't mean to say it was sold properly....there are many criteria for mis-selling and usually there are a number which apply to an individual.

Indeed some of them were pre-ticked boxes and you couldn't proceed with your application if you unticked the box or, if it wasn't pre-ticked, you may not have been allowed to proceed until you did tick the box.

Fos have frowned on a number of lenders for their on-line sales practices in years gone by.

As this is their final response you can go to fos or you can approach them again with your concerns and a schedule of claim (spreadsheet) and a completed fos questionnaire.

What from did your claim for mis-selling take?

ims
