    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?
    • Thank you! Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.   
    • I've looked at your case specifically more.   Term 8bii reads " when, in accordance with instructions from the Customer or the Consignee, the Consignment is left in a safe place" Their terms choose to not define safe, so they are put to proof that the location is safe. If your property opens onto a street its a simple thing of putting a google earth image and pointing out that its not a safe place

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks littlesally, I know they try to make you sign stuff about 'full and final settlements'. However, even if I did sign anything (which I don't intend to ;) ), as far as I'm aware it doesn't matter what I sign as it's my legal right to claim what is mine. I refer to this in a post from Stonelaughter on

"It doesn't matter what you sign; you cannot sign a legal right away if it's granted in Law. You could sign an affadavit saying I will never ever claim from you again for anything at all; and then claim the next day because you are legally entitled to that for which you claim.

 

So - even if you signed an "any and all claims, and all future claims" clause, it could only make it slightly more difficult. You can claim for charges going back as far as the bank has records; although no-one has tried to go beyond the six years yet in court."

Just a thought, but if your partner believes he has a pretty good credit history but is struggling to get a bank acct, and if you stay at the same address, maybe its because they are linking your financial status with his (Sorry to say!?). Just a thought. I know you can put an entry in a credit file to say you guys are not financially linked etc. If I was him I would send for his credit report(S) and leave off getting a joint acct or making any joint applications on anything until you get your credit history cleaned up - this site has got lots of good info for getting defaults removed etc to assist with this.

Thanks for your tips both - my partner and I already have our credit reports (although I didnt know you could get them for free, hmph!) and neither of us show up on the others. We are both digging into our credit histories, he's found a default which he'd forgotten about so thinks that is whats preventing him getting a current account. However, this will drop off in a couple of months, so he's not too worried about it. We've only been living together since April, so we are not officially linked financially at all - everything is in his name, we don't have any joint accounts or anything in joint names. I just make my contribution direct to him in cash or bank transfers.

 

I have started looking into how to improve my credit rating/file.... I have a lot of reading ahead of me as I want to make sure I have all the info I need before taking any action. In the short term I'm just concentrating on this RBS claim, my recently closed Sky account and my recently cancelled New Look store card as these are all current issues. I want to get these all done and dusted before I start looking into old debts etc.

 

So hopefully on the road to financial recovery.... a long way to go yet though.

Howdy Lucy.

Barclaycard and a company called Vanquis offer credit cards to people with pretty bad credit histories, it's not like the Capital 1 card where you have to pay them a deposit. They only offer £250 credit limits, and their interest rates / APR's are pretty high, but if you get one and perhaps spend £10 a month, or get your weekly shop on it once a month, then pay back the balance in full it'll greatly improve your credit rating, that's what i did, I didn't hardly use the card and set up a direct debit to pay the balance in full at the end of each month, since then I've managed to get a mortgage and a loan, so I think it definately worked for me.

 

You do need to have the self control to not use it all the time though, 'cause the APR is a killer.

Can I just ask - has anyone attempted to claim more than £5 in England all at once, without splitting the claim up?? I would be interested to know more if there is any info on the subject??

I can't be sure but I think there have been. It looks like Jenkellyxx is doing something similar so check out their thread, Davefirewalker's advice was to adjust it to less than £5k and then do them separately I guess.

Hiya BC, yep, I know I'm supposed to divide it up and do it in 2 claims....but being ever impatient would quite like to get it over with in one go:rolleyes: ... anyway, I wasn't sure if anyone had actually dared do this yet!! If I could do it all at once £6,000 would clear all my debts off (student loan aside) plus I wouldn't have to go through all this rigmarole again :) ...maybe I'm just lazy?! :wink:

Im kinda doing the same thing, but im in Scotland so have to split up a claim of £2360 into 3 or 4 claims (£750 limit in Scotland), I am however going to just submit all 4 at the same time, so theoretically the bank should just settle them all at the same time.

In the letters to the bank im just claiming for the full amount.

I intend to split it at the court stage, which should be in just under two weeks (I doubt they'll settle before then 'cause I havn't had 1 reply to any letter I've sent them yet).

im in the similar boat to yuorself as i was sick of barclays sending paper saying admin charge here and there while at university, asked for a ist of statements from year 2000 september, so will seek more guidnce soon hehe

Ha! There was me boasting on someone elses thread about RBS not taking the £10 S.A.R - (Subject Access Request) fee, and its gone out today, more than a month after they sent my statements to me!! I reckon its because I didn't mention the part about reclaiming charges in my SAR, and now they've received my prelim they're playing nasty - how flippin' childish!

I must be doing something wrong, I sent my LBA last week and I havn't had 1 response yet (at all, to any of my letters) :(

 

Remember to keep to your timetable, not theirs (as polite as they might be :) ).

Yep, thats what I thought, thanks sleepz. The more I read it, the more I think its just a standard letter as their complaints procedure (yes I read the leaflet!!) states they try to resolve things within 2 weeks. Where've you been sending your letters? I've been sending to my branch (Middlesbrough) and they've been fairly prompt with replies so far... once it gets to 'Head Office' though, I can see it being dragged out like everyone else's.
