      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well they got till tomorrow to reply to my LBA, the initial flurry of letters form barclays ( who are dealing with it) has dried up good and proper and have heard nothgin for two weeks now so i guess im back of to court tommorrow :)

hmmm dilemma, we have been turned down for the parachute account we had set up, not sure i want to issue court papers tomorrow as we "bank" with woolwich, if they decided to close our banking down we would be stuck for dd's etc. might delay untill i have an effective parachte set up but does anyone know how i can check my credit report online and find out why the bank turned us down? ( they didnt say) it was halifax BTW. hmmmm, dilemma

I wish you luck on it being settled by Xmas but i started against the wooly in june done SAR,Prelim,LBA,N1,Allocation questionaire and got a prelim hearing Jan 27th 2007 AT Dartfod CC.

They seem be takeing it right to the wire unfortunatley.

Experian or Equifax do an online check cant remember what it costs but sumtimes they do a trial for a month for free (you have to sign up for a year but cancel it before the 30 days are up.

As far as I know they haven't closed any accounts down.

You will need to contact the court and ask if they have submitted their AQ.

I expect they will fax it to the court today. I wouldnt worry to much they are just trying to scare you off. They will pay in the end.

woolwich had filed on the last day supposedly but i still havent had a copy of it or in fact anythign from them! guess ill get a hearign date of march and settle down to wait then

 

meanwhile there are 4 more charges of £35 to add to the bill, anyone thingk AQ is too late to add them ( get an ammendment done as i understand the £35 fee is not refundable) or do i wait till they settle and then mention the other 4 charges they might like to consider while they are at it to save this process again? ( bearing in mind i have my mortgage with them and dont want my account closed, despite a parachute acct elsewhere)

thoughts anyone?

morning all, ok decided nto to ammend my claim given that it woudl have effectivly started everything over again and put me back ages,

 

i have a court date for a hearing 30th march at 11.30!

i have to prepare a "skeleton argument" and "statement" and "evidence (including any documents) which i intend to rely on during the hearing" is this the court bundle i have heard tell of?

off to investegate :)

BTW as yet they have entered into NO conversation with me about this case, no letters other than the standard "we are looking into your complaint" gumph ages ago.

Give them a ring and ask if now a court date has been set do they wish to settle now if you want litigations phone no just ask.

ok have rung temi and she was unable to find details of my claim so suggested i email her. sending this email, comments anyone?

thank you for takling with me this morning regarding my claim, the case details are as follows. southampton county court claim number XXXXXXX filed 25th october 2006. claimant TRACEYRMJ & mr traceyrmj v woolwich. woolwich customer number XXXXXXXXX ( me)

original sum claimed £ including court fees of £ and the provision for 8% persuant to s69. the current amount with interest at todays date is £, however 5 further charges have been added to the account since then at £175, making the total £ obviously i would appreciate it if those 5 subsequent charges were included in the settlement as i hope to continue banking with woolwich and wish to avoid having to issue proceedings subsequent to any settlemnent.

court date for a hearing lasting 1 hour 30 mins on 30th march 2007 at southampton county court. issued by diustric judge AINSWORTH dated 28th December 2006

please find attached spread sheets both of the current amount with interest and also of the total including the subsequent charges.
