      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, statement affixed. You need to read through it and insert the information where I have put XXX's (remove the XX's). When you print out the statement make sure your printer is set for A4 paper (not letter size, which is the default on most PC's).

 

On the copy letters - you need to write the claim number on the top left hand corner and Appendix 1 on the top right hand corner.

 

Do the same on the budget sheet, except it is Appendix 2.

 

Affix the appendices to the statement (you need to take another two copies of all of that, so you have 3 sets - one for the judge, one for the other side and one for yourself).

Thanks for that, in the statement you have asked for a suspended order due to the fact that the situation is of their making should we ask for the matter to be set aside? Im not questioning your invaluable knowledge but a suspended means we will still be paying even if they dont rectify the situation. If a suspended order is granted and we pay the full sum off in say the next month can we get this withdrawn or will the suspended order be in place for the rest of the mortgage?

Hi, if the total arrears were caused as a result of the PPi not being paid then you may have a case for asking for adjournement rather than suspension. However, the judge may wonder why you have not pursued the matter more vigorously given that the arrears are 10 months.

 

When the arrears are paid off you can apply to the court to have the suspension lifted.

The judge may decide to adjourn the hearing when he knows of the PPI issue

 

Good Luck, will be thinking about you. Tell your wife to stay positive. When she gets to the court ask if there are any free legal reps there, they can come into the hearing with you and speak to the judge.

Thanks to everyone, I went to court not got susspended repo order, but the judge was great. I offered 150 per month on top of mortgage, but he advised it was too much and suggested 50 which was put on order. The other side also wanted payment by 24th of this month he said no and set first payment for september. Their lawyer was furious, it was a pleasure to see. During my wait in court i heard of 6 cases similar to this where PPI hadnt paid out I think it is a cheek the mortgage companies not paying their own PPI out and seeking repo orders. I would be interesting to find our how many arrears are due to PPI.

Well done for that seems like you had a fair judge:). And it is important that you have and affordable arrangement or you will be back to square one.

 

So I guess the next move is to take action on the PPI . Have you done an SAR letter? And have you started a thread for this in the relevant forum.

 

you never know the PPI might clear the arrears and if it does I hope they remove any defaults on your credit file.

 

Have they actually given you a full written explanation of why the PPI has not paid out?
