Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Well we have now had our eviction date ,my youngest sons birthday, 17th August and have been told that we can fill in a N244 form to try and stop the repossession

I have down loaded one and am ready to fill it in , I lost my business a while ago due to bad debtors but am about to be offered a job !! I need help filling it in and also what paperwork should I take to the court , I am also not happy about the charges that they have added should I mention them ??

Hi

 

If you can prove to a Judge that you can afford to pay your normal monthly payment plus a chunk off your arrears, there is a good chance of saving your home.

 

Don't give up and have a read of this for inspiration and the names of people to approach on CAG

who is your mortgage with ?

 

I was in a similar position, I was so ashamed but managed to pull myself together jsut at the last moment. The judge will be ok if you can explain your reasons why you can now afford to pay.

 

Be sensible as well with your repayment offer. The Judge will calculate how long it will take you to pay the extra, work it our for yourself and really ensure that you can pay as remember interest rates may go up at any time.

Hi there, I can help you with the N244. You will need to affix a budget sheet to the form to show the judge how you intend to pay the mortgage and arrears. I have affixed the budget sheet we normally use - let me know when you have filled it in and what you can afford to pay.

 

Do you have an up to date statement showing the charges they have added to your account?

 

I also need to know:

 

Is the mortgage in joint names?

How many children are living in the property?

did you attend a repossession hearing? if so when was it and what did you agree to pay?

Ell-en in answer to your questions I have filled the budget sheet in and can forward this to you

We are also in the position that we have excessive charges and have requested off them twice to send us a breakdown which have been ignored I have tried filling the N244 in but am not very good I can send you copies of the breakdown and the letters we have sent to them along with a statement of how we got into this position and what we intend to do to get out of it

We also have an issue with them that we have to have their insurance cover even though we had our own cover copies of which we sent to them ,again ignored !!

My youngest son is 16

Sorry missed a few questions , I did attend the last hearing 12 months ago and we have adhered to the court order until recently it is in joint names with my husband and I paid £250 minimum a month

Unfortunately we didn't send the letters recorded as at the time we didn,t realise what Capstone were like they were always quite pleasant on the phone hmmm guess we were naive did not realise they were so two faced

Hi, the statement for Q.10 is affixed. You need to insert the info where there are XXX's at the top and also in the body of the statement (remove the XXX's). When you print it out make sure your printer is set for A4 paper and not Letter size, so it all stays on one page.

 

You need copies of the three letters you sent and the budget sheet. On each of these 4 documents you need to write the claim number on the top left hand corner.

 

On the first letter you sent write Appendix 1 on the top right hand corner

On the budget sheet write Appendix 2, and on the 2nd and 3rd letters you sent write Appendix 3 ( you will see where they're referred to in the statement).

 

Now assemble as follows@

 

N244 - signed

Statement - signed

1st letter - appendix 1

Budget sheet - appendix 2

2nd & 3rd letters - appendix 3

 

This forms the pack for you to take to court. Staple all the pack securely together. You will need to take a copy of it all for yourself to refer to in court.

 

When you take it into the court they should be able to tell you what date your hearing will be. There will be a fee of £35.00 to pay (take cash, most courts don't take car payments).

Well folks we won !!! BUT I have to say the judge was so biased towards SPML that we thought we were going to lose he was laughing and joking with their Solicitor he wasnt interested in anything we had to say about the arrears and when I told him I had a new job he said we didnt know how long I would keep it , he didnt care about the charges incurred at all but at the end of the day he gave us one last chance so we have to be thankful for small mercies , we now have to pay £175 off the arrears and if we miss one we cannot ask for another suspension he was not interested in how much we had paid off the last lot of arrears in fact he wasnt interested in us at all !!! Crikey - which court was this? it's a shame you got such a numptie for a judge, but at least you kept your home. Well done for being so brave:)
