Hi

 

My wife and I have got behind on our credit cards with Capital One and we have now defaulted and off to a debt collector.

 

In the past there was a lot of chatter about claiming back credit card charges and I know the courts have ruled against bank charge claims saying they are fair ish

 

Is it possible for me to pursue a reclaim of credit card charges against Capital One, even though they will say their fees are low and reasonable and can I attempt to claim them all back.

 

If I can then I'll start reading and getting my debt paid off with the charges they owe me!

Hi,

Simple answer-yes.

 

Long answer- Cap1 will argue the toss right up to the court steps but usually fold before it gets in front of a judge

 

The how to.

 

1 find out how much you have been charged (if you don't have all your statements-SAR them)

2 Work out how much they owe you-with interest

3 send a preliminary letter

4 they reject or offer you the difference between £12 and the rate they were charging you

5 Letter before action rejecting their offer and asking for the full amount

6 They reject your demands

7 Sue
