Hello, this is my first post and i am after a bit of advise.

i sent my first letter by recorded delivery along with a cheque of £10 to the abbey on 18/08/06.

recieved a reply yesterday confirming that it is being dealt with as a complaint. they stated that they will reply within 8 weeks of their letter dated 1/09/06.

is this correct? or is it 40 days from my letter?

 

i have asked for a copy of statements since account opened, and there was no refrence to the statements within the letter. When i rang up and spoke to someone regarding this they refused to speaj to me about it.

shall i just bied my time?

Did you make it plain that your letter was a Data Protection Act SAR letter?

From receipt of a SAR letter, they have 40 days to comply. If no compliance within 40 days they ar committing an offence and should be reported to the Information Commission Office.

 

Unfortunately, because of scant information from you, it's not possible to be more specific.

I would hazard a guess that you drafted your own letter from scratch. Am I right ?

If so, that was your second mistake !

Your first was not reading the FAQs.

O.K.

 

That was the correct letter.

Write to them (recorded delivery) and remind them that you sent a D.P.A. S.A.R - (Subject Access Request) on the 18th Aug.

Remind them that they now have only XXX days to comply with your request.

Warn them that any attempts to delay or avoid compliance will result in representations being made to the Information Commissioners Office.

Incidentally, don't let the bank impose its own timetable on you, which it will take any opportunity to do.

You're driving THIS bus and you work to YOUR timetable. :)
