    • ok your WS is wrong. Paragraph 16 and 17 says  you did not contract with evri but this is not true - see below  Furthermore to the eBay Powered By Packlink T&Cs that Evri is referring to, Clauses 3b and c of the T&Cs states:  (b)   Packlink is a package dispatch search engine that acts as an intermediary between its Users and Transport Agencies. Through the Website, Users can check the prices that different Transport Agencies offer for shipments and contract with the Transport Agency that best suits their needs on-line. (c)  Each User shall then enter into its own contract with the chosen Transport Agency. Packlink does not have any control over, and disclaims all liability that may arise in contracts between a User and a Transport Agency post 251 of occy thread - £844 lost    you should also add a paragraph on donough v Stevenson talking about the fact that even without contract there is still duty of care to goods and by failing to deliver this duty has been breached.   Make those changes and post it back up here and I'll check over things again
    • no we cant add the occy thing because leicster are being difficult people so we're just going to go without it for now

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I just use Photobucket, but would love to learn if there is a quicker way. My drag and drop method when you simply want to show a picture in a post is the fastest at the moment, but would love to know how to paste a screen print easier.

Yep, same here, it gets a wee bit tiresome to do it the PB way, but this method is with Chrome, do you use that?

I use Firefox, but may switch to Chrome if that's the only browser it works on. Let me know the instructions for Chrome please Bookster. If it doesn't work for Firefox, I will install Chrome.

Muchas Gracias:-D

This is how I do it

right click a picture

select properties

copy the address URL for the picture

paste it into CAG with [lMG] in front and [/lMG] after

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

Or send a cheque or postal order payable to Reclaim the Right Ltd.

to

923 Finchley Road London NW11 7PE

Click here if you fancy an email address that shows you mean business! (only £6 and that will really help CAG)

If you can't donate, please use the Internet Search boxes on the CAG pages - these will generate a small but regular income for the site

Please also consider using the

C.A.G. Toolbar

Sod'em, here's the Chrome extension link:

https://chrome.google.com/extensions/detail/ckibcdccnfeookdmbahgiakhnjcddpki

Once installed, follow GH2008 instructions:

When you use it, it takes you to a new page where you can crop and edit it.

Then click share and it will give you a URL.

That URL actually links to a webpage with your image - if you want an inline image in your post then right click the link - copy link address, then when you insert image into your post, paste the URL and add .png on teh end and that will paste the image inline.

As you can see as above, it took me a few trys to get it right, but getting there. I'll see if I can do a mini-tut to help.

I can put images on here quicker than Locotus' suggestion. (I Just have 2 tabs open, 1 with Cag reply box ready, and 1 with the picture I want to paste). I just drag the picture to the CAG tab (CAG reply box will then appear), and then drop it in the reply box. You won't get any quicker than that. I was just wondering about posting a picture of a print screen without having to use Photo bucket.

Ok, so...:

Say this is the page you want to scrnshot:

minitut1.jpg

Click on the little camera next to the address bar.

it will open a new page:

minitut2.jpg

Do what you have to do, crop, text, whatever, then click on "share", it will then say "uploading", then it will give you a link:

minitut3.jpg

Right click and copy link.

Click on the "insert image" here on CAG bar :

257160-9262010110022PM.png

insert the URL in the box AND type .png at the end.

Preview post to see if you got it right, and voila. I think.

It must only be Chrome that has that. Firefox has a million and one add ons, I will see if it has a similar one to the camera on Chrome. Otherwise, Chrome it is. Although I am really happy with Firefox.

Have you tried posting a picture the way I said you can Bookie? Give it a try.

I don't know, I just found it out by acciden really. I always have a few tabs open anyway, but the Bear Garden is always one. I get the reply box ready to whatever thread I am replying to. Then I just find the pic I want on a spare tab. Left click on the image (keeping the button pressed). Then drag the image up to the CAG tab. The CAG page appears back and the picture is still with me. I then just hover over the reply box and release the button. I have only ever used Firefox really so am not sure about any other browsers at all.:???:

Just tried to do it with IE. That doesn't work either. I can't see me wanting to post a print screen that often, so I think I will stick with Firefox for now.:whoo:Go Firefox.
