    • Interesting question regarding what Government accounts opposition parties have access to, before an General Election. From what I understand, Government department accounts that are published are always lagging behind and would not include some amounts which are classified as 'commercially sensitive'.  Therefore opposition parties and Parliamentrary select committees would not have access to accounts which contain real time up to date information. If a new Government have found £20 billion of spending liabilities they did not know about, this could be true, as £20 billion is not that much when you look at total Government expenditure. Government department are making decisions on spending all of the time and it could be the previous Government were planning tax changes and/or spending cuts to balance the books.  Jeremy Hunt has recently said that if the Tories had stayed in Government and held an Autumn budget, it would have been very difficult to cut taxes as some had wanted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

found this site after going through google and need some help to get this right.

 

My daughter bought some tickets for a concert which arrived the day after they was to be used which made them worthless but the seller (private) seems to think its not thier problem as she now has the tickets. ( not that they posted them SD at 1pm on the date of the ticket). can anyone tell me where she stands.

Fully entitled to a full refund. If the tickets were posted on the day they were to be used, the seller made sure they could not be used.

 

Now, there could be a very good reason for this. They could be counterfeit tickets which is very common. So, firstly check with the venue whether the ticket numbers are genuine. If they are not bring the police in immediately. If they are genuine, keep the envelope they came in and a photocopy of the tickets. Demand a full and immediate refund.

What did the ebay auction say about delivery?

 

If it mentions that the tickets would be delivered before the concert date, then she'll need to open an "item not as described" dispute. She needs to use the wording on the advert carefully to find a reason why they weren't as described.

 

A non delivery dispute is a no go area, as they did arrive, and all paypal or ebay will want is a delivery tracking number.

And with a signature, they will close the dispute not caring that the tickets were for the previous day. I have to question the poiunt of posting tickets thae day they are to be used - so the fact they may be fake is a great ruse... What was the delay between purcvhasing and posting?

Buzby the delay between paying and the seller send was 5 days.

 

gadgetgirl79. I will have a look at the advert to see what was said

 

wheelergeezer. I have ask her to find out if the tickets are genuine, not sure how she can do that now the festival has past but she will have a go.

 

would anyone know if she would be able to go through the smalls claims court for late delivery ?

Do remember - Delivery wasn't late. It was posted late and delivered in time, something you can prove by printing off the posting receipt which will show the sending date to be the same as the the event. Secondly, sending an email to the promoter with a scan or jpeg of the ticket should be enough to query authenticity.

 

A SC action will only work if the address you have is legitimate, and it may not be.

There is no doubt in my mind that the tickets were sent late on purpose. That would suggest they are not authentic. As advised above, contact the promotor.

 

What did the seller actually say when contacted? Did the tickets arrive the day of the concert or were posted the day of the concert?

 

If they arrived the day of the concert, did that 1pm arrival deadline leave her enough time to get to the venue as she planned? Had your duaghter tried to contact the seller before this date? What was the arrangement in the listing as there is no listings past or present showing for that user name.
