      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've spent months trying to clear my mountain of payday loans which was all my own doing, no-one forced me to apply for them.

 

I should be clear in by the end of the year but i just feel so down about everything at the moment.

 

Quickquid are still being a nightmare but thankfully they are banking the postal orders i am sending monthly for the arrangement they refused, even though they are taking about 4 weeks to clear as they're sent to the US apparently. Really could do without them writing to me with their name across the envelopes though. Especially as our Postie left the mail sticking out today so anyone that went past could see the Quickquid logo on the envelope

 

The other company that was causing me so much stress have backed off after seeing from my payments (i sent them an extra few pounds last week which seemed to have caused a few chuckles but hey, it's an overpayment) that i am really trying to clear the debt quickly.

 

I have wrecked my credit rating and am having to make excuses to family and friend as to why i can't go out to any parties/get-togethers because i have absolutely no spare money left each month. I have had an official warning at work thanks to Quickquid calling me 8 times in one day when the loan first defaulted

 

I just wish i could have known when i started that first loan application nearly 18 months ago how much these loans would ruin my life and i would never have applied.

 

If you're reading this and are considering applying for a payday loan, ask yourself if you are 100% you will clear the loan in full on the due date. If you can't, please stay away from them as it is so easy to get sucked into the spiral of the payday loan trap.

I am new here and would really like some advice. Have been reading some posts but can't find any current advice on the payday company that I am dealing with! I took out a loan with pounds til pay day and am not in a position to pay the full amount back. I have so far reported my card as lost and cancelled the direct debit (am checking every day that they have not set a new one up). I have written to their address in Malta requesting that I set up a pay plan with them- they have not replied. I am so worried about them contacting me at work as I don't think I could handle the humiliation. Any ideas about what I can do to get them to agree to a payment plan? I owe them 700 and would be able to afford about 40 a month at the moment.

please help :-(

i had to get a wonga loan out to cover my car breaking down

 

luckily enough ill have the cash to clear the loan. not something i ever wanted to do (include owning a credit card)

 

they can be useful if you can cover the cost..

Well done to OP for getting there with the PDLs - they are awful, but there is light at the end of the tunnel. I should be clear soonish - I've paid a few off and am on payment plans with the others and should be ther within 6 months. Keep going - they are terrible but you are getting there!

Which company is it? I think I have an idea as there's only one I know of based in Malta. Change your numbers on their website in your personal details section so they can't contact you at work and insist on having everything in writing even if you do talk to them. That way you have proof of what you have offered.

they are hard to deal with. But why should you be humiliated if they call you. As long as you answer the phone and feed them the same answer and offer of payment of £40.00 per month - they'll get tired and will pass the debt on to some other company who will accept... easy ;-)

PTP's account managers are from the troll school of charm and it pays to be pretty tough to deal with them. If they do ring you at work, tell them under no circumstances are they allowed to call you at work - say that you are not allowed to accept personal calls. They will eventually pass the debt on to Clarity who are lovely to deal with in the relative scale of DCAs.

 

I had a few run-ins with the charm school of PTP and they specialise in bullying people so stay strong and stick to your guns. There are a few other threads on here from people who have dealt with them and the trick is to wait until they get bored (about a month) and pass it on.
